Easy.  Prove you had a bonafide marriage before the divorce via the usual methods, i.e. the ones you'd use for ROC anyway.

3/2/18  E-filed N-400 under 5 year rule

3/26/18 Biometrics

7/2019-12/2019 (Yes, 16- 21 months) Estimated time to interview MSP office.

Look at the pinned topics at the top of this forum and collect all the evidence you possibly can to prove that the marriage was legitimate and just didn't work out. If you divorce, you don't have to wait til the end of your conditional permanent residency to file I-751 with a divorce waiver; you can file whenever you have your divorce certificate in hand.

If you believe your spouse is going to try to sabotage your ROC, make sure you have a separate mailing address (if you haven't moved out yet, get a mailbox somewhere) and have all USCIS mail go there. That way your spouse won't even know exactly when you've filed and what you've heard.

So my advice would be to collect all that information, and then grant your spouse a divorce as soon as possible, then file ROC on your own.

I'm not sure if this advice will actually work, since you haven't linked your timeline, so I don't know when you actually have to file.

Is your timeline updated?

A pinned topic is a topic that stays at the top of the forum regardless of how many threads are made.  There are a couple about evidence.

But no, just because she "says" it was a business arrangement doesnt mean anything. She would need to be able to prove it was.  Just like you have to provide evidence that you married in good faith.
