Filed: K-1 Visa Country: Serbia
Timeline

They requested complete federal income tax return for 2016 along with the affidavit of support. Now I am wondering if sending it regular mail vs priority hurt my chances of them getting it. Since the address are different (I mailed it to the correct one) but the express one clearly states USCIS attention: adjustment of status.  I am just super scared now since I basically have no status at the moment.

@GreatDane thank you! he filed 2016 as single. I cannot think of an administrative mistake we could have made. 

 

Another thing is that I was born in Bosnia, but filed my k1 visa and AOS as a citizen of Serbia since I have lived there most recently. I mean I don’t know if that can affect it in any way or appear as inconsistent.

Was there a co-sponsor? If so, did you send both tax returns?
Honestly, you'll have to wait until you get the notice of denial. Then, I think, we can help more.

@GreatDane he was the only sponsor. You’re right, I am going to wait to get an exact idea what went wrong. It is just so nerve wrecking not having a clue what happened. Thank you so much for all your help.

You are fine.

 

Doesn't matter how you send it it will get to the same place.

 

I have a feeling the documents with the I-864 wasn't enough. No pay stubs or anything like that.

But when looking at the dates it can't be because they haven't responded since it hasn't even been a month since they got the RFE October 26

I agree because they give you at least 30 days? to send in the response and October 26th to November 7th is just 11 days !

What was their reason for requesting it? I also think something wasn't enough but your answers aren't detailed enough to make an evaluation of that.

@Georgia16 we have not provided pay stubs since we thought tax returns for past three years were sufficient. However, would they have not RFE for them mailing RFE for tax return.

@Suss&Camm they said that those were missing in our file (affidavit and tax return for 2016). When I filed my application I included tax return for past three years, affidavit of support, I765 form and I485 form along with my birth certificate, copy of the visa and my passport, marriage certificate and a check for both fees totaling $1225 (I still have copy of it), copy of I94 and photos. I had a work permit after I graduated as an international student student. It was approved June 2015 and it expired May 2016, but actually left the US before my work permit expired (March 2016) and have copy of I94 that shows that.

They asked for the I-864 and all financial stuff is a part of that so I think that could be a reason for it. 

 

They received your response for the RFE but it wasn't sufficient so they denied you.

 

But wait for the letter to come and you'll see what it is. Just don't panic you can file again.

My point is the same as Georgia's. You haven't mentioned anywhere what proof of income and additional docs you sent. 

Details are very important with rfe's, which makes it so hard to advise without seeing the exact list requested and the exact list responded.

@dnp2014 we did meet the income requirement. My husband makes well above the poverty line even with the part time position. I’m addition to that we included the amount of savings in his bank account.

 

I am fearing it could have indeed been lack of pay stubs, perhaps letter from the employer and the bank statements. I just would not think they would straight up deny without any warning about missing documents.

They would "straight up deny you" if there were missing documents after having sent an RFE. But from the RFE and your response it doesn't seem like you missed documents. 

Wait for the letter and then get back to us!
