You had a one page tax transcript?  That sounds unusual.  Off the top of my head, mine are usually over 6 pages.

Mine was 1 page as well, except the year I itemized, which was a few pages.

@EvieMN I stated I was born in Bosnia, and I put my citizenships as both Serbian and Bosnian - I have dual. However, I entered the country on K1 visa as a Serbian citizen since I lived and worked in Serbia at the time of the application.  When I was an international student I was On a student visa as a Bosnian citizen. I don’t know if that would form some discrepancy.

I would almost want to say that your history with US immigration is inconsistent - between the Bosnia student visa and the K1 Serbia visa - it is almost as if it is two different individuals with different citizenships applying for visa / immigration benefits .....

From what I know , you would have to file with the country in which you were born - which in your case was Bosnia - you would have then listed Serbia as a residence and additional citizenship....

  • sending I130 05/16/2007
  • cheque is cashed on 06/11/2007
  • NOA1 in mail 06/13/2007 (who said 13 is badluck )
  • 07/30/2007 After no touches and no other signs we just got an email with the APPROVAL of I130....Thank God !....now what ?

  • 08/07/2007 Case received by NVC and case number assigned :))

  • 08/13/2007 DS3032 and AOS bill were generated

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

  • 08/21/2007 DS3032 and AOS fee bill arive in mail

  • 08/27/2007 paid AOS fee bill
  • 8/28/2007 DS3032 choice of agent accepted
  • 9/3/2007 IV fee bill generated

I don't think this probably created the issues you think it does.  My husband's birth country was incorrectly listed on his visa and in the system as Sweden. He's Danish. There were no issues.

When you say your sent them your husband's tax returns, were they complete tax returns, including all schedules and forms that were originally submitted to the IRS?

For a tax return to be acceptable to USCIS it must include every form and schedule; for this reason, many people instead submit IRS tax transcripts, which combine everything you submitted in a tax return into a single self-contained document, and are acceptable to USCIS.

This happened to us. Really silly but sometimes they want the "official" tax transcript from the IRS. Just in case you made some funny business on the copies you sent them. Maybe this is all there is to your problem? I do not like to make mountains out of molehills. Until you receive the letter, no one can actually give you exact advice. This is one of the reasons god created bars.

What is the worst case scenario for this? Can I re-file or appeal? Am I going to be deported due to being out of legal status here?

Assuming there is not a Notice To Appear (NTA) as well, you can file again. Overstay is ignored for a spouse of a USC anyway.

A Motion To Reopen (MTR) can be filed instead if the reason for denial was a mistake and you can show that.

But the most important thing is to figure out why it was denied.

were you born before 1991? I am asking this because neither Bosnia nor Serbia existed as a country before 1991 but Yugoslavia. So if you were born before 1991 your country of birth, for any and every purpose in the US , is Yugoslavia, not Bosnia.  Here in the US, the facts about one's birth are from the time of birth, not how that country or city is called nowadays. However; this is not an issue even if you wrote Bosnia,  most people make this mistake. And no, it does not matter at all if you are a dual citizen. In the forms you write down the citizenship of the country which passport you used to enter the US. You only list all citizenships if you are specifically asked to do so.

Wait till you get the denial letter and go from there. you can file again and being out of status, in your case, does not matter for AOS. you are a spouse of a US citizen, you entered the US legally. You can adjust your status. Do not worry about it too much.

srećno i nadam se će ovo uskoro da se reši i da je u pitanju samo neka greška.

I suspect your lack of providing a complete tax return or a tax transcript is the source of the denial.

If that is the case then you cannot appeal, since the mistake was yours, but you can re-apply for which you would need to pay all the fees again.

@Hypnos from what I can think of, looks like our tax return wasn’t complete. I assume that once they RFE something and it’s incomplete they just deny the case without sending another warning. Which makes sense unfortunately.
