Vaccionation Requirement for issuance of K-1 Visa?

Hello everyone !

We just recieved our NOA2 and we are both very excited .

However, some of my fiancee’s family has had a very severe adverse reaction to vaccionation. For this reason ,  I completely understand and support her fear and concern for herself and her young daughter .  I have read and studied this topic for countless hours and I see that everyone says that the vaccine requirement isn’t mandatory for issuance of K-1 visa but in the states it will definitely be needed at the adjustment of status stage , at that point there is a waiver available which we plan on doing . 

On the state department web site it says vaccines are “ optional “ and on the policy manual for adjudicators on USCIS it clearly states that they are indeed “ optional “ and not mandatory for issuance of k-1 visa .

But I have also heard that some embassies don’t abide by this and make the vaccines mandatory.

My fiancée will have her interview at the US embassy in Moscow . 

If the vaccines are indeed “ optional “ as the state department web site says and the policy manual for USCIS, why would embassies force vaccines on the k-1 beneficiary ?

If anyone has any information on the embassy in Moscow and on the vaccine requirement for K-1 visa issuance I would greatly appreciate it .

I understand that this is a very controversial and loaded topic with some people but please understand that there have been very bad adverse reactions to vaccines to some members of my fiencee’s family .

It would depend on if your fiancé or their daughter has ever had a severe reaction themselves, the degree of reaction that their relative has had, and their relatives relationship with them - e.g. sister in law versus parent. 

 

I have an immediate relative that is allergic to an injection but I still had to have mine, even though by my own countries standard I had finished the course. 

 

Also note that depending on the state some places won’t let the daughter go to school unless she is immunized.

If it’s a genuine medical issue they can get medical waivers (including for schools that usually require it).

Sure but from the sounds of it the fiancé and daughter don’t have a medical issue just their relatives do which has made them weary of having the injections.

Yes , I have checked for my state and we can get a medical waiver .

I am more worried about the issuance of the K-1 visa at her interview in Moscow because she will not get the vaccines for herself or daughter .

Although it clearly says vaccine are “ OPTIONAL” according to USCIS and the state department, I am very concerned about this .

I can’t really enjoy and celebrate our NOA2 because of this .

This is a battle you will have to decide whether the fight is worth it. Without them having their own reactions a medical waiver will be next to impossible to get. 

Even if it was a sibling it does not mean they would react also. Plus the daughter is another generation removed from that relative that had a reaction. 

 

My youngest developed Guillian Barre's at 18 months. He got it so bad he almost ended up on a ventilator. It progressed so fast that doctors thought he was having a stroke. He lost the ability to walk, sit, and even hold his own head up. It took months to recover. it's been 2 years an we can still see the damaged it's done to him. Guess what his sister still can not get a medical waiver for vaccines.

~~Moved to the RUB forum, from K1 P&P - As each country sets it's own requirements on the medical. Some countries one cannot get the medical completed without all vaccines done prior to the Interview.~~

What about when the daughter comes and have to attend school? They are pretty strict with all the vaccines at least they are here where we live.

 

The vaccines are not a requirement for the K-1. She will get a vaccine sheet from the doctor (DS-3025) there will be marked as incomplete. The problem will be when she gets here and you have to do the AOS process because there they are required (or is you can get the waiver).

I have talked with schools in my state and there is a waiver available they told me.

What I’m more worried about is the Moscow Embassy enforcing vaccines for k-1 visa issuance .

I appreciate your response and input .

Yes, they are strict here in the states with vaccines but we will file the I-601 waiver of vaccionation requirement with USCIS at AOS and then we will have to file waiver at school.

Right now my concern is the interview at the embassy .

They shouldn't refuse the NIV for the vaccinations. As fore AOS...

There's no grounds for filing an I-601 for waiver of waiver of the immigrant vaccination requirement based on fears or not wanting to do so. The waivers are only available when they are medically inappropriate (i.e. there is a consider medical risk posed by the vaccines as determined by a CS and/or CDC, or shortage of supply), or upon religious or moral convictions that can be sufficiently evidenced.

 

Going for the waiver due to religious or moral convictions is honestly quite difficult to obtain...likely adding considerable time to the case, considerable costs for the waiver (if not filed concurrently) or attorney, etc. This is very far from a cakewalk and needs more than just her saying she doesn't believe in vaccines or believing they are harmful to be successful. I suggest researching the topic and running some searches on VJ for others who have tried to obtain the waiver. Most were not successful. A very small handful were.

Thanks for your kind response .

Long story short , even though some of her family members have had bad reactions to vaccines , she is a nutritionist and is against vaccines on moral grounds .

The only thing we can do is try and file the I-601 waiver based on sincere moral objections at AOS, if we’re denied then we will move to another country .

But for now , I just hope she can get the K-1 visa at the embassy and then we can try and see what happens in the states .

Be prepared with plenty of evidence, and if you can, please post an update or new thread with how it goes at the time.

 

K-1 is a non-immigrant visa, but is processed by the immigrant visa unit at the embassies.

Most States have a few different types of waivers you can get for school. 

 

The hard part here is will they require the vaccines at the medical like they do in Canada? 

If they don't then applying for AOS they again will have to get the vaccines completed. Moral grounds is not something I've seen ppl win at for not getting vaccines when it comes to Immigration. I've seen plenty of posts of ppl trying but never a post of them succeeding.
