Hi! I will try to make this short and sweet. This is what happened to me. I brought my indian fiance here jan 06 and we legally married here through local courthouse on march 17 06. On april 12 06 he moved out and left me and I have not heard or seen him since. I have no idea if he is in the usa still or where he may be. I never filed adjustment on him and i signed off the case soon as i learned he was gone without a trace. Well actually he did email me once to say sorry things didnt work out , that he was not comfortable here ect. I was hurt for the past year over this hoping maybe i would hear from him or things would work out somehow. But now i want to move on with my life and I would like to get an anullment of the marriage based on abandonment and fraud. Does anyone know if i need an attorney for this or can i go to courthouse and do it myself?. I dont have anywhere to serve him any papers because he is gone and i have no information on him and his where abouts. Any help needed. Thanks

You can not have an annulment, since you have been married for over a year.

Also, when you call USCIS to tell them what happened, I'd love to know how you answer the question "Why didn't you report this a year ago?" I think your response, that you wanted to work it out is not true.

I have reported it to ins a year ago and signed off the case after 3 months of him being here.He conned me into marriage legally here pretending he was the same loving person whom i fell in love with online and when i went to india he was great too. It was after he got me in the courthouse that i realised how fake he was! He was recieving unknown calls from people here in the usa in which he was hiding , he threatened me and My 8 year old and he moved away from me to supposedly take a job in which was just to be close to his friends whom he apparently knew was coming to usa . He totally frauded me and after marriage legally i realised this! I did not take action against him as far as divorce sooner because he is very mentally unstable and i feared what may happen.! lets put it this way anyone who says they hope your 8 year old ###### of a daughter gets raped is one sicko whom no matter what kind of love i had for that thing who calls himself a human that love will die after hearing that! I just want to move on now and im finally not scared anymore thats why i posted and i will proceed with an annullment because this marriage was one fraud from his part no matter what! If i need to do a divorce then i will but i wanted an anullment because that would totally erase him from my marital status and i dont want to admit that i even married such a animal!

The annulment rate in all the states is relatively low because the grounds for annulment are hard to prove. Pennsylvania annulment laws, like all the other states, have also tailored grounds for annulment, which are:

Bigamy or Existence of a Prior Marriage

Existence of a prior marriage is a legal annulment ground. According to Pennsylvania annulment laws, you can’t enter into another marriage while still being married to someone else. You can marry only one person at a time and existence of a prior marriage will make your new marriage void and thus it can be annulled.

Incest

According to Pennsylvania annulment laws, incest is a valid annulment ground. Therefore marriages between father-daughter, mother-son, uncle-niece, and aunt-nephew and such like can be annulled under this annulment ground.

Mental Illness

You can obtain annulment under Pennsylvania annulment laws, if your spouse has some kind of mental illness.

Physical Disability

Under Pennsylvania annulment laws, you can obtain annulment if physical disability in your spouse is hindering you from having a normal married life.

I will need a lawyer i guess. the problem is i have no idea where to find him and also when he left he took all documents we had , all of our pictures , he deleted the memory from my computer , stole everything that could have helped me find him. he even gave me the wrong birth date and uses a diff name also. i have done paid services to try to track him down so when i got an attorney i have info on his where abouts to notify him.he is one sneaky person and the day he left i went for breakfast with my child and when i came back he took everything , even all my baby pictures and each and every picture i had in my house from my childhood , my daughters things. this person is one sick o!

This citation does not cover all possible annulment options in Pennsylvania. The quoted text refers to "void" marriages, or marriages that were never legal in the first place. There are circumstances where an individual may annul a marriage by declaring it "voidable". In other words, the union was recognised as legal in the court's eyes, but that there were facts related to that legal union, that would have caused the individual to choose not to marry had they been aware. In this instance, the OP could try to annul the marriage on the grounds that her alien husband achieved his ends through fraudulent inducement into marriage.
