Hi! I will try to make this short and sweet. This is what happened to me. I brought my indian fiance here jan 06 and we legally married here through local courthouse on march 17 06. On april 12 06 he moved out and left me and I have not heard or seen him since. I have no idea if he is in the usa still or where he may be. I never filed adjustment on him and i signed off the case soon as i learned he was gone without a trace. Well actually he did email me once to say sorry things didnt work out , that he was not comfortable here ect. I was hurt for the past year over this hoping maybe i would hear from him or things would work out somehow. But now i want to move on with my life and I would like to get an anullment of the marriage based on abandonment and fraud. Does anyone know if i need an attorney for this or can i go to courthouse and do it myself?. I dont have anywhere to serve him any papers because he is gone and i have no information on him and his where abouts. Any help needed. Thanks

In some cities there are legal aid offices that can assist you in doing filings yourself. You might want to check around, it could save you a lot of money rather than using an attorney. Good luck :thumbs:

Last year you wrote that your husband inadvertently left the country without AP. What was the disposition on that? I am confused. Your former post suggested he moved in with a friend into a place you and he were going to call your home...do you now not know that address in order to serve him with divorce papers?

Report also to the homeland security coz' looks like fraud. He arrived Jan and yet he waited until you married him and not even a month left you and say "sorry things didn't work out and he's not comfortable here", which I don't buy that.

Divorce/annulment laws fall within state jurisdiction, and since you don't mention which state you reside in, I doubt anyone can answer your questions in the particular. Of course, relative to state, one can file a petition to divorce without the assistance of an attorney. Likewise for an annulment, but I would caution you that after a marriage one year in duration a family court might be disinclined to automaticcaly grant an annulment without the claim being articulated well and based upon a firm legal foundation. You might be wise to have an initial consult with a lawyer (usually free of charge) to look into what, in particular, you must do to make it happen.

All you have to do you is to the court house in the county you got married, ask for the papers to file your own divorce, fill them out, you will need to pay a filling fee (unless you have some type of Public Asst. IE: food stamps, medicaid, etc, they will then waive the fee) If you need help in filling the papers just ask the person at the window. You will need to give last known address on where the police can try to serve him the papers. If it was your house known last, explain this to the woman/man at the window and they should give you another form to fill out for the local newspaper. They will place an ad there, because that was the last known place for him to be, and they will run that add for (I believe it was 3-4 weeks) truly can not remember exactly how long it was (I did it myself, this is how I know). They are giving notice to him that you are getting divorced, if he does not answer the add in the amount of time it is placed for then you will have an instruction package of what more you need to do. It was a fairly easy process to do yourself, and they MONEY YOU WILL SAVE, you won't believe. It is a easy open close case, if he is not present then there is nothing to fight over, or divide, etc. Hoipe I was a help, WJR

Kinda depends upon which state that you file in. Some states require court approval after demonstrating that you have exhausted all other means of personal service before they allow you to do a constructive service (i.e. legal section of a newspaper)

I would ensure that he does not try to adjust status.

Call Customs and Border Protection and report him.

Make sure you separate from him legally so that they can go after him.
