Want to get married but still married in US

I'm ready to marry my future hubby in pakastan but my divorce to my American husband is not final yet. I've heard that the laws in Pakistan are different as far as marriage is concerned. My divorce is final in December but I'm only able to travel to Pakistan in November is it possible for me to marry him in Pakistan in November get my divorce from my first husband in December and then file for his Visa soon after.

No that will not be possible. 

 

As stated above the US will not recognize that new marriage since you are already married and it's illegal to be married to more then one person.

No, you have to wait until you are divorced before you can get married.

No. It isn't the rules in a foreign country USCIS go by, it's the rules in the USA. You will have to wait until you are actually divorced first.

Such marriage may or may not be recognized by Pakistan (polygamy is permitted in some cases IIRC), but is not legal in the US. I'm thinking it's not allowed as I thought it only applied to multiple wives, not husbands. Correct me if I'm wrong here.

 

Either way, only the first marriage would be recognized by USCIS. You must be fully divorced before you marry somebody else and can petition for them.

and to the other, yes, men can have multiple wives in some religions if he can afford them and if the first wife agrees 

but the woman can not have multiple husbands

they would not even let you marry in Pakistan as they have laws to follow

·        The death certificate of your former partner

Your divorce must be final and a divorce decree included in your petition. A marriage certificate also must be submitted and if they see you
married before your divorce was final then you will be denied. Best to change your travel plans or marry on one of your next trips.
Your embassy is not easy and you should visit several times. Marrying on your first trip can be a red flag, get to know him better first and
establish good relationship evidence to front load your petition.

You will need the paperwork from your divorce certified at the U.S. Consulate and that can not happen until your divorce is final.  Feel free to travel and visit your fiance - it is a great way to establish evidence of a bona fide relationship prior to marriage.

 

I understand your feeling the blush of a new relationship, however, temper that with the reality that if you do things out of order or incorrectly it can cost you MORE time and money than it would to wait and do it the correct way the first time.

A few words on polygamous marriage in the US according to ICNA - Islamic Council of North America and ISNA these groups of Islamic scholars have said Muslims living in the USA should follow the laws of the land meaning not engage in polygamous marriage as its considered illegal as is bigamy.

 

Please do not engage in a temporary marriage of any kind also known as an "orfi" marriage because it provides none of the legal rights or protections that an Islamic marriage will for yourself or any children that result from the relationship - children from these marriages are not considered to exist in some countries ie Egypt meaning they have no citizenship or rights under the law nor are the fathers of these children legally bound to care for them in anyway.  This is a legal form of prostitution in the majority of Islamic scholars eyes because it makes sex legal between two people for a set amount of time whereas a marriage is entered into with the intention to last until death.

 

Be sure to have an ironclad marriage contract - anything can be laid out in it - from dowry to child custody upon divorce.

 

I encourage you to read and educate yourself on both Pakistani culture, language and customs as well as Islam the religion your future spouse is coming from.
