Hi All,

 

Quick question, as you can see from my previous topics, i am getting married to my US Citizen Fiance on 31st December 2017 - we will be filing the I-130 in the next days after.

 

Two questions in reality i need help with..

 

- If, when i leave on the 6th Jan 2018 will this be classed as abandonment of the I-130 Petition (Other half will not be coming with me & will be stayin in USA)? 

- My, then husband, will be visiting me in the UK at Easter 2018 & i want to know if this will be classed as abandonment of the I-130 Petition?

- If, when i attempt to visit in June 2018 & September 2018 & then leave again to return home to UK until all processes have been completed and visa in hand, will it be classed as Abandonment of Greencard/petiiton?!

 

Can someone clarify this for me?!

 

Also if we file in January 2017 (Best time of the year i hear as less petitions are filed?) will it be likely to be processed slightly quicker then the current trends? If you could give a rough idea of how long its going to take between NOA1 & NOA2 Then NOA2 to Interview @ London Embassy that would be fab. Looking at the stats/trends it seems like it may take anywhere up to 350 days from filing the I-130 to Green Card in hand?

 

As a heads up, my fiance is a regular cashier and will be filing a affidavit of support with our packet & we are both medically clear & no police records, no previous marriages, a lot of relationship/marriage evidence. We are going to enquire about a joint account & potentially open one over Xmas & then look at phone plans too.

You have to wait for the marriage certificate before you can apply for the visa.

 

The CR-1 (Spouse visa) can not be abandon because you go home or visit that is what the visa is about. The USC petition for their foreign spouse living in their homecountry. 

 

Expect 12-14 months for the whole process.

The only abandonment would be if you married and applied for adjustment of status (greencard application) while remaining in the US. If you left before getting your AP travel card (or a greencard decision), your greencard application would be abandoned. 

 

Your I-130 petition is not abandoned.

I 130 is just proof of relationship.

 

Strongly suggest you read up on the process.

Timeline

  You have the I130 petition  for spousal visa and the I485 petition to adjust status.   You can file and I130 and fly to the moon and it still moves along.  The I485 requires that you stay in the US while it is pending.

This will not be over quickly. You will not enjoy this.

September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
