K1 or CR1 kindly advice

I met my fiancé on Facebook 2 years ago and she visited my family last year, stayed in my house for 12 days, there we were engaged. She wants me to come stay with her but we do not know the right visa we should use. Should she visit me again and we get married and do a CR1 or do we apply for K1 at once. We have a 19 years age difference (she's older) and I live in Lagos, Nigeria

Yes, I would say go with the CR-1 visa and have visit/visits before filing and also doing the process.

I agree with @Georgia16, the CR1 is probably the best option here and given the circumstances, the more in person visits, the better.

my personal opinion, The Cr1 is a better choice. Visit her a few more times before you start the process. You'll be okay. I hope things work out.

I agree also - although doing more visits and waiting before you get married is frustrating, but you want a SUCCESSFUL visa in the end, not Administrative Processing or an unapproved visa - so doing many visits FIRST is likely to get you a better chance at the results you are looking for.

You can do whatever you want, but in the end, people find ways to do what is important.  We are all busy. I have 3 children and a full time job, but I find at least a week to visit my fiance (soon to be husband) at least every few months. The consulate won't care about her work schedule or how busy she is. They will see she hasn't visited you for a year and will wonder why. 

 

Would you marry a woman 19 years older than you after meeting her once if she was Nigerian? If the answer is no, they will ask a lot of question about why you would an American woman.

Nigeria is considered as high risk country for visa. Of course you can married on the next visit and file it after the third visit. However, in high risk country, the more you visit the better chance it will be. I'm not saying that if you visit less, you will get denied, however, the probability is like that. Furthermore, you guys have a red flag since she is 19 years older than you. Better safe than sorry. Visit more.  Good luck with your relationship and upcoming journey!

The embassy won't care how busy she is because we all lead busy lives, but we still do what we have to do in order to get our loved ones here...As mentioned many times before, Nigeria is a high fraud country, so the more visits, the better so please tell her to get more visits in before filing..I visit my husband twice before the process, once while our petition is in process, and going again for the interview...Age can sometimes can play a factor, but back it up with quality evidence...I know of some with slightly bigger age gaps than yours and was approved in Nigeria..Good luck to you dear...

As others have stated you have some "red flags" that you're going to want to compensate for in other ways.

 

- You met online (higher potential for fraud then meeting in other ways, lots of scams online right - especially from Nigeria in that regard)

- It appears you've visited only once, and got engaged that trip (also more similar to fraudulent cases)

 - You are 19 years older (a larger than usual age gap)

- The woman is older than the man (it's not as common, especially with the age gap)

- You are Nigerian (from a high fraud country)

 

None of these are bad by themselves, but you must remember the officer is trying to look at the whole picture and make a decision, one where unfortunately many fraudsters do their best to "look legitimate", so he/she must decide if it is or not.

 

The CR1 visa is probably the way to go as others have state, but getting married in your country still does not gaurantee you will be approved to come to the US.

 

You will want to show significant evidence this is a bonafide relationship, and the best way to do that is multiple meetings in person. I know you say she is busy, but then the question is "too busy for the one you love?" coupled with the red flags, it just doesn't look good and you will need to prioritize your relationship over whatever else it is that keeps you both busy.

Thanks for the advice. I will have to hold on to our marriage plans for now but pls how many number of visits do you think is neccesary before we can file.

Depends how long she stays on each one.  Two month long visits are better than 5 weekend visits.  There is no "necessary" number, only you guys can decide that.  You may want to contact @dwheels76 because she's also gone through Lagos and has experience on VJ.

To OP I will also say get married shows commitment especially with a large age gap. Me and my husbands is bigger than that and we had no issues at interview (except a system issue). But I also stayed in Nigeria 6 months.
You can file soon as you marry . I mean you were going to fly now after engagement. Visit during the process , she comes for interview if you want.
Long visits are a big plus I mean after marriage you are married and well married people live together. They feel you staying longer you know each other better. Sure not many can do what I did but hopefully when she comes for wedding make it a few weeks file and plane another one. It will be at least a 12 to 14 month process so plan accordingly.
