Submit all supporting tac documentation (W-2s, 1099s, Form 2555, and all supporting tax schedules) submitted to the Internal Revenue Service for the most recent tax year.

The joint sponsor must submit all supporting tax documents for the most recent tax year.

Based on the documents submitted with Form I-864, Affidavit of Support, for the joint sponsor, the income did not meet 125% of the poverty guidelines for the joint sponsor's household based on household size.

Submit evidence of assets that meet the standards listed below or obtain a different joint sponsor.
Assets must equal the stated difference between the joint sponsor's household income and 125% of the poverty guideline.

Assets must equal the difference for applicants filing as orphans.
Assets must equal three times the difference for a spouse or child of a United States citizen
Assets must equal five times for all others

Evidence of assets includes:

Bank statements covering the last 12 months (statements will be averaged over a 12 month period) or a statement from an officer of the bank or other financial institution in which the sponsor has desposits, the account balance averaged over a 12 month period, and current balance;
Evidence of ownership and value of stocks, bonds, and certificates of deposit;
Evidence of ownership and value/equity of other personal property and dates acquired;
Evidence of ownership, a recent licensed appraisal or county tax assessment, and any mortgages/lien or lien release of any real estate

 

I received this REF from the USCIS and I have some questions, so please help

1)   My joint sponsor filling tax jointly with his wife and they don’t have separated income, the total income for both (they are self-employees) and I just filled the i-864 for the husband only. Should I have to submit the wife i-864. and the line 22 in 1040 10x the poverty guideline.

2)   USCIS asking about the w-2s and they don’t have w-2s

3)   For the evidence of assets includes: should I have to submit all these evidences or just one of them.

How long have they been self-employed for? Also what kind of business is it? Did you compute the household size correctly? You need to provide more info for specific help. Amounts, numbers of people, what you sent etc,.

 

Generally you have to submit the complete tax return including the schedule C. If the income is sufficient you wont be using assets.

thank you, but i think you are experts in these issues, he is working as self employee from a long time and i filled the i-864 correctly except the amount each year because i didn't use the line 22 in 1040, and i submitted the tax return for the last three year, and he made more than 150k each year.

 

Today i spoke with immigration officer on the uscis hotline, and asked him about all my question and i will write them to you here and i need your opinion, because they wont give you the exact thing you need to submit. 

 

Q1) i asked him about which supporting documents i have to submit (w-2s, 2555, 1099s, schedules), and answered me anyone of these forms shows the income for your joint sponsor, and i told him that he doesn't have w-2s , he agreed and told me to submit the 1099s, and for the schedules you've to submit them again, but i already submitted them in the entire tax return. ? what do you think ???

 

Q2) and i asked him about the assets and which evidence they need, and he told me to send something like the bank statement for the last 12 months and evidence shows that he has house or vehicle or any things like that ?? what do you think ???  and im asking you what about the stock and bonds and certificate of deposits. 

 

Q3) He works as a self employee and he filled the tax return jointly and they have the same money and everything and shared the business also, and when i submitted the concurrent filling only for (i-864 primary petitioner) and (i-864 joint sponsor Husband) and i didn't file the i-864a for his wife, and i don't know f i need it or not? but the immigration officer said ya ya doesn't matter? ? what do you think ???

 

Help me what to do ???
