US citizenship help

Hi i got my green card from marriage in 2013  and then I got removal of condition in May 2015 after that things didn’t work well so we got separated in aug 2015 and divorced approved in jan 2016 

now my 5 years has been done and I’m going to apply US citizenship 

my question is , will it impact on my citizenship as I’m divorced ?

No, as you are not applying based on marriage it won't matter. Remember that your 5 years counts from the date printed on your first green card, not when you got married, filed paperwork, or got AED/AP. If you married in 2013, it's too early for you to apply for naturalization.

it will impact the perception the interviewer will have of your case -

 

considering the small amount of time between May and August - expect lots of questions about the marriage that got you your GC - they will want to make sure it was obtained legally and naturalization is the last gate for them to actually verify that and stop any illegally obtained Green Cards...

 

just because you are applying based on 5 years , it does not mean in any way they cannot ask you any questions about your marriage - they can ask you anything they want and probably will - and the separation following immediately after ROC will be a very strong flag on your case

  • 07/30/2007 After no touches and no other signs we just got an email with the APPROVAL of I130....Thank God !....now what ?

  • 08/13/2007 DS3032 and AOS bill were generated

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

  • 08/21/2007 DS3032 and AOS fee bill arive in mail

  • 08/27/2007 paid AOS fee bill
  • 8/28/2007 DS3032 choice of agent accepted
  • 9/3/2007 IV fee bill generated

this is a red flag...you will  definitely experience lots of questions regarding this marriage from the officer. But since you are applying under 5 year rule, it would not be a death blow though.

 H1b ---> EB-1A (I-140) ---> I-485 AOS(Green Card) ---> 5 years --->  US Citizenship N400 application

  • Day 011/16/2017, e-filing N400
  • Day 3069/18/2018,  interview day--passed and in line for oath.
  • Day 332: 10/15/2018, Oath Day
