Okay so i am not sure if this is the right forum but hopefully I can get some advice!

 

I am a canadian citizen and went to school in Texas in 2009-2013. I graduated and then worked on an OPT visa. Once my visa expired, i stayed and returned home a few times, but fell into an Overstay. I returned home sept/2016 ( even after overstaying ) and was still allowed to travel back to the US but finally returned home in March 2017.

I went to travel to the US in July 2017 with my boyfriend for his brothers graduation and a friends wedding over the course of 2 1/2 weeks. I called prior to travelling to see if I was allowed due to the 6 month travel time and customs said yes because I had been home already for months and I could prove I had no intention of staying. So while travelling to the border, i was flagged and brought in for questioning. I was drilled into about my previous overstay and the usual interview/questioning about my travel plans and intention and I was completely honest. That being said, the customs agent granted me permission to travel and cut me a break and said he was doing me a favour because I was travelling with my boyfriend who is a US Marine.

 

So he granted me a B-2 dated for the duration of my trip and threatened my return. When I got to Texas, i seeked advice from a laywer to see if I could legally do anything to stay ( NOT TRYING TO RISK ANYTHING OR STAY OVER THE B-2). If i couldnt do anything, then I would return like I was told. He told me I had 2 options, A TN-visa or k-1. I was not engaged at the time so I said I could go the TN path. 

I live very close to the Mexican border when in school so I could deal with immigration there. 

The lawyer set me up with a TN package and told me to travel to the Mexican border and apply on return.

When I did so ( with a few days left on my B-2) I was then detained and questioned which was completely honest again which officers would say would benefit me in the situation.

After 10 hours, they finally transferred me to a local detention center and was detained there for 3 weeks. It was one of the WORST experiences of my live and was mistreated while there and told multiple lies from ICE.

i was not allowed to see a judge because I was on expedited removal.

 

they sent me home Aug 16th and when I landed and got my belongings, all they sent me home with was my flight itinerary and a paper that i was given at the border stating my reason for being inadmissible 😡😡. I was looking at the paper and why I was inadmissible was for not having valid documentation/visa/passport, etc. So how is the the reason for my being inadmissible when I did have a visa and my passport!!!

 

So now im in a position of looking to apply for return. My boyfriend and I are engaged ( have been together since early 2014) and Im not sure which route to take!!

i called USCIS and someone said to apply for a K-1 and then once denied, apply for i-601? 

 

Any help?!

You told them at the border you only wanted to attend a graduation and a wedding, they granted you the duration of stay for that, but you decided to explore options of staying back once you got in. 

 

Some lawyer set you up with a bogus TN package when you didn’t have a job offer and asked you to apply from the Mexican border. Do you realize TN is a work visa? Your entire narrative doesn’t say anything about having a job offer on hand. 

 

You didn’t think the US immigration will eventually put two and two together?

It was a multiple entry. Do canadians need a visa to onenter the US?

 

You do not need a visa to visit the US as a tourist, that is a privilege. Your visa-visa status is not as of a right.

 

Think about it, if you invited me to your wedding ceremony, does that mean I can stay till your kids went to high school?
