On the affidavit of support for my fiance through the K1 visa do I need to list his son on it even though he will not be moving over here with him? We listed him on the petition obviously because it requested any children he had but his son will be staying with his ex and visiting us during summer holidays soooo does he still need to be listed on the I-134? I would think not but I would just like to double check...

The instructions say:

Answer all questions fully and accurately. If a question does not apply to you (for example, if you have never been married and the question asks “Provide the name of your current spouse”), type or print “N/A,” unless otherwise directed.

If he does have children, then N/A would not be the correct response. Give their names and information. The section is

Part 2. Information About the Beneficiary

It is biographical as much as anything so they want to know if he has children.

Even if he will not be moving with him and not be sponsored by me? Because where it has a section about a spouse it says in parenthesis (accompanying or planning to following beneficiary)

That is how I interpret it and how I filled mine out. There is no qualifier on children like "if accompanying". It says

Beneficiary's Children

I had children so I named them. It does not say list your children IF they are immigrating. I take the form literally without trying to overthink it into something they didn't say. Ultimately it's your form to fill out in the most accurate way you interpret it, so pick one. I don't think it's a deal breaker either way you do it.
