He is unlikely to get tourist visa from Ghana as high fraud country

and he is unlikely to get a K1 for the same reason

at this point get your surgery and start the healing process

then, when you are able to travel, go to meet him

unforuately you really need multiple trips and face time with him to be approved in Ghana embassy for a K1

also, don't try going and marrying on 1st visit,  denial will happen

 

you have gotten the best advice here 

you can not start the process for him to come without meeting him (;probalby several times)

also be aware if you are unable to work because of your illness, you need cosponsor to support both of you and themselves according to the 125% poverty guidelines

and on K1 it takes quite a long time to process the other applications and pay fees to allow him to work

you need to check USCIS site and see all that is envolved with a K1 or any other visa like CR1 which is spouse

Well we do not know his details but somebody cultivating a relationship in such a situation is unlikely to also be somebody who would qualify for a B Visa.

you are advising a person to do something that would result in a ban

Lots of people visit GF's in the US, I did, not a ban issue.

 

I also used to say visiting GF, did so many times.

Ohh. This is a High Fraud Country, so be very careful. Please. You have to meet him in person, and preferably more than two to three times. Preferably marry and live in Ghana for a couple of years before applying for him to come here. With your medical situation and healthcare in Ghana....not sure.

He probably will not get a visa to visit you.....so sorry....

Find another country you can meet him in.  Canada or Mexico would be closer for you and that may relieve some of the stress of travel.  You will have to meet before filing so figure out the easiest and least stressful way to do that.

 

As stated, Ghana is a very high fraud country so he will most likely not get a tourist visa.  The K-1 is also VERY difficult there without proof of many visits and a long relationship.  Visas are difficult to get there but not impossible.  Unfortunately you will have to have better proof there than most other parts of the world.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

In an effort to confirm what others have already mentioned, and to shed new light on a few concerns, let me share.

 

1. It is an ABSOLUTE requirement that you meet physically at least once within two years of filing for the K1.

 

2. Ghana is a country rich in fraud. All other hurdles aside, you have a severely intense ride ahead of you even in ideal conditions. Perfect K1's have been denied many, many times simply because of the beneficiary's country-of-origin. 

 

3. Waivers are extremely rare. While I would never discourage somebody from trying, be prepared. That means do your homework. If you are asking if it is a requirement to visit physically, then you are in the baby stages of researching. You're not prepared...yet. Read. Read some more and then read again. Ask questions. Visit forums relevant to his country and your situation. Talk to folks who have already gone through the process. Learn from them. 

 

4. Your medical condition will likely not warrant a waiver of any sort. I'm not trying to discourage you, but simply to guide you to find a successful alternative.

 

5. If all else fails, wait. If you are both in love then waiting another year won't matter. It will be challenging, but not impossible. I waited five years for my fiancé. It is a tough sacrifice, but well worth it.

 

6. Ask him to apply for a visitor visa to the U.S. or meet him in Mexico or Canada. Doing so keeps you close to home and still allows you meet K1 requirements. If you do meet, document it. Evidence is paramount to a successful K1. Visit the forums here for guidance and direction on applying.

March 2014: Officially hired attorney and filed for Dyn's annulment in Bohol, Philippines

December 2015: Bohol District Court issues decision in our favor

April 19 2016: Received CENOMAR and Annotated MC from PSA via private courier. DONE! COMPLETE! FINISHED! OFFICIAL!

I-129F / K1 VISA APPLICATION PROCESS

April 04 2016: I-129F sent to Texas Lockbox via USPS Priority Mail

April 12 2016: Email from USCIS acceptance confirmation

April 17 2016: Official NOA1 hard copy received

July 12 2016: NOA2 Approval hard copy received

July 14 2016: Post Decision Activity email from USCIS

THE LONG WAIT (USCIS misplaced approved petition)

September 16 2016: NVC received approved I-129F petition and assigns case number

INTERVIEW / MEDICAL PROCESS

October 04 2016: Day 1 of medical at SLEC in Manila

October 05 2016: Psychiatric evaluation off-site due to psychological incapacity annulment (10 hour eval with 800 question profile test)

October 13 2016: CFO Seminar completed successfully and certificate awarded (CFO stamp not issued until visa is presented).

October 20 2016: Return to SLEC complete psychological evaluation with resident psychologist (less than ten minutes)

October 21 2016: Vaccination day at SLEC (medical finally complete)

October 25 2016: Visa interview at USEM in Manila (APPROVED)

HOMECOMING

November 19 2016: Dyn's arrival at POE Dulles IAD in Washington DC

December 01 2016: Married

The issue is not the visit, it is because he is from Ghana and Ghana is a very high fraud area.  A tourist visa will be incredibly difficult to get from there.

It isn't a ban issue.  It is possible to get a tourist visa to visit a GF or fiancee.  It would result in a difficult situation if they got married during the tourist visit.  That may be considered visa fraud.

You can marry as a visitor, I think you are referring to planning to stay prior to entry.,

Section 212 (a)(6)(C) states:

(i) In general.-Any alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or admission into the United States or other benefit provided under this Act is inadmissible.

The inadmissibility that results from this violation of immigration law is a lifetime bar to entry.

 

so, if the Ghana resident says not coming to visit financee he is commiting fraud

and if, at interview in Ghana he says going to visit my financee,   he will not get the tourist visa as this is Ghana / they rarely approve tourist, K1 and even CR1
