hello everybody, im just new here so i was wondering may be you guys could help me?

we'll i just got a quick question. im a u.s citizen but after i stayed in the u.s for 7 yrs i decided to go back to the philippines to study there. I stayed in the philippines for about 5-6 years (which i had to pay for the penalty for overstaying) but anyway i have a girlfriend back in the philippines for 5 yrs now and was thinking of petitioning her, now im already here in the u.s since may  (6 months now) but i havent had luck to get a full time job. my question is, would i still be able to petition my girlfriend (for fiance visa) even though i dont have a job yet? can i ask my mother and sister to do a sponsorship? or do i have to have a fulltime job before i can petition her? please let me know if you guys know the answer thank you

Yes, you can petition for her without a job. However, she will not be able to work for several months after her arrival. How do you plan to eat? Where will you live? How will you pay all the required fees? 

 

It would probably make more sense to go for a CR-1 spouse visa (get married first). She will be able to work immediately upon arrival and it's a cheaper process.

is there like any requirements i need to be able to file a fiance visa for her? Yea i know she wont be able to look for a job for a several months. I can take care of all the required fees my self. I just want to file the fiance visa asap. As soon as i file it, the faster she gets here. Im actually been trying to look for a fulltime job. dont worry maam ive got a family to help me,
