Husband filing for a divorce before ROC. Not enough financial stuff comingle

Hello to fellow vj friends,

 

I am currently on a depressed/ stressed situation 😔

I just need to hear from those who had the same situation as mine.

 

So I came over March 2016, via K1 visa, got married, file AOS, got my 2 year GC October last year.... first several months being married and living together we were fine, happy and had plans for the future and all...

Then things changed, we have some trust issues, my USC husband kind of manipulative- though he didn’t hurt me physically, but emotionally he drained me, but he make it all like it’s all my fault. So, lots of fight, silent-treatment,etc... To make it short, I moved out from the house last May. 

So at this point- we are heading to divorce, actually did the paper works already and just need to be mailed in to the court..

 

My worries- since he has his house,cars, etc, he owns everything before we got married. 

The only things we have together :

 1.) 2016 joint tax

 2.) medical and dental insurance- that I am under his insurance.. several photos with family, we travel to Seattle last year.

No joint bank account, credit cards, nothing...

 

Soon as our divorce will be done- and got the divorce decree, as far as I’ve read- I can file for ROC right away by myself, but I worry that I cannot provide enough evidence about financial stuff together.

 

is there someone can shed some light on me?

i worry my case is not strong, but it was real,our relationship was real but things happen 😔.

Do you mean what did I submit when I file for AOS?

We made 3 separate packages sent them together

AOS package 1:( this was our own way for assembling the AOS package)

 

1.) form I-485

2.)Payment ($1070) biometrics fee included 

3.)copy of my passport ( biopage and visa entry stamps

4.)copy of form I-797 (NOA2)

5.)copy of e-form I-94 ( arrival form)

6.) copy of BC

7.) certified copy of marriage certificate 

8.) form 325A (  my biographic form)

9.) 2 passport size photos

10.) copy of ds-3025 ( vaccination sheets from Philippines) 

 

PACKAGE 2: 

form I- 864 affidavit of support ( petitioner)

1.) form I -864

2. Copy of petitioner’s birth cert

3. Copy of petitioner’s passport 

4.)copy of employment letter

5. Copy of federal tax returns, years - 2015,2014,2013

6. Copy of most recent pay stubs

 

PACKAGE 3 I-765( application for employment authorization)

2.)  copy of my passport with visa stamps

3.)  copy of e-form I-94 ( arrival/ departure record)

 

4.) certified copy of marriage certificate 

 

5.) two copies passport photos

 

I had my interview on October 11, 2016 at ASC Honolulu 

 

I hope these helps.  I received my 2 year GC via mail On October 20,2016

 

and Thr EAD card on October 28,2016

Hou didn't have joint car insurance, membership to anywhere, any joint bills or just bills in your name, any pension or anything like that where you were the beneficiary, can you get statements from anyone saying you in fact were are couple?

Hello Georgia16,

no car insurance, no utility bills on my name, since everything is under his, i didn’t bother to ask bout these stuff, and the beneficiary of his life insurance,401k is his son.. is there a problem a huge problem with my case? I am really worried that my case is so weak and possibility to be denied. Yeah i got a friend and her husband who knows everything our relationship.

All you can send is what you have... you'll need a good cover letter that explains your situation and as much "secondary evidence" as you can gather. Secondary evidence can include:

  • Photos of the 2 of you (at family functions, on trips, etc)
  • Proof of any travelling you did together (plane tickets, hotel reservations etc)
  • Affidavits (letters from people who knew you as a couple) testifying to the fact that your marriage was real and not just a way for you to get to the US.)

Your written English is pretty good, but I might also suggest that you have someone whose native language is English write your cover letter for you (based on the information you give them) - you want the cover letter to be as clear and understandable as possible. That person does not have to be a lawyer; just a person who is a good writer and has a good command of writing business letters in English.

Thank you for your words, yes I can ask someone to help me atleast help me with the cover letter.

I think I can ask my future ex husband to do so. We are in good terms, do you think it helps my case if he gonna write an affidavit that our marriage was legit. We’ve been together for about a year only but we’ve known each other since 2011. But I know what matters now is from our marriage and so on.

 

and now I’m working- i still gonna put him as my ‘contact person’ in case of emergency ‘ and my beneficiary of my insurance ‘ hope that helps.

If your ex is willing to help you that's going to be a big bonus, I think - I imagine that him writing an affidavit that backs up your statement that "it was a real marriage; it just didn't work out" would carry a lot of weight with USCIS (or at least be a pleasant surprise - they're probably used to seeing either no help at all from the ex-spouse or that the ex-spouse is actively trying to sabotage the ROC process... we certainly see a lot of that "marriage didn't work out and now I'm mad and want to send my ex home to wherever s/he came from" rhetoric here on VJ - I can only imagine how much they get at USCIS!)

Yes, he is willing to help me with the ROC. We are trying to remain civil and nice to each other as much as possible cause we used to love each other, just that we are not good as a couple.

 

I told him that I will give it a try to file with divorce waiver, and I’m going to hope for the best and prepare for the worst, gonna ready myself of the possibility to be denied and I will gladly go back to Philippines.

in most states (and you can ask life insurance agent in Hawaii) the wife is automarically the main beneficary unless she signs off to give to other

have your attorney bring this up in the divorce

your husband signed affidvit of support and seems unwilling to support you

sorry he did not include you in his life 

i feel sometimes the foreigner thinks life here is so much better they don't question the man what will happen when financee arrives

Yeah, he is not a bad person, but he was hard to deal with. I didn’t really care about financial stuff at first because I just waiting him to open up to me bout those but he never, he never trusted me any sort of thing. And I just knew that he put his ex wife ( mother of his son) as beneficiary of his accidental life insurance. But I don’t want him to think that just about insurance.. he would make it sound that I was just after money which is not.

 

now, that we are getting divorce, and need ROC alone, I’m so stressed out. Not so much evidence. But like what I’ve ve posted earlier I will give it a try to file with divorce waiver and submitt whatever I have. 

Hard to be here, Have no family. I still don’t drive. 

If ever I’ll be denied I won’t appeal. Too much for me to handle. But going back sure will devastate me.
