Best to contact his Consulate in Italy and get a passport/Travel Document.

  • B. Emergency Travel Document

    REQUIREMENTS
     
    • Completed Application Form
    • Two passport size photographs
    • 10€ fee in Money Order only payable to the Embassy of the Gambia (Free of charge for minors under 12)
    • Gambian identification (Gambian national ID, Birth Certificate, Driver’s License, Voter’s card or Marriage Certificate)
    • Police Report indicating loss of Passport
    • Copy of air ticket
    • For minors, passport of the parents and Birth Certificate

    IMPORTANT:
    In order to issue Emergency Travel Documents, the Embassy must satisfy itself that applicant is a Gambian.

Tine for him to sort himself out, must be a common issue.

So he has successfully applied for and been granted asylum in Italy? He has residency status there?

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

No mention of him qualifying for asylum.

He doesn't have to be a legal citizen, but he does have to be a legal resident.

You might want to ask the US consulate in Italy that conducts the interviews what their requirements are for a visa applicant to interview there.  He might have to go back to Gambia.

I understand Italy is willing to provide certain concessions to those who agree to leave. If your fiance decides to go that route, it would help if he can negotiate that they give him a clean police certificate as part of the deal.

 

He will need it in case you decide to file for K-1 visa leter.

I think it's okay. Just make sure he has his Gambian passport. Also, he will need secondary proofs of Identity since he doesn't have full permission in Italy. ...Birth Certificate, school records..etc
