Greetings,

 

I hope everyone is doing well. I have a bit of a situation related to DV lottery 2087.  I, for the past 6 years used to file DV lottery for my niece as single. last year I filed for her as usual, but I completely forgot that she got married, so I did not include her husband information "force of habit". luckily for her, she got selected as a winner this year. she submitted the DS-260 form including her husband.

 

I am wondering if this situation is going to affect her chance to get the visa, will there be any complications during the interview at the consulate? as the marriage date was two years earlier than the initial DV lottery application, the situation is a little bit worrying. any advice suggestion is highly appreciated.

Her application is invalidated. 

 

It's a hard and fast rule. 

 

She will not be immigrating (at least, not in this cycle).

Doesn't matter -- she is still responsible for the information submitted.  She should save her money and not pay any  of the fees to move forward with the process, as she will be refused at the interview...the consular officer has no choice.  It's an automatic disqualification to not include your spouse and children in the application form.

Unfortunately all the above responses are correct. In addition to what’s been quoted already, note this is unambiguously highlighted and emphasized in the instructions for selectees (linked in the selection letter):

 

Important note: If you had a spouse or children prior to submitting your original entry, but you did not include them on your original entry form, then your case will be disqualified at the time of your visa interview. Neither you nor any of your family members will receive visas.

I’m struggling to understand how a lie should be viewed as a ‘honest’ mistake. You clearly lied when you selected single as her marital status when the truth is she’s been married for two years. I don’t know how a close relative forgets that important part of one’s life. 

 

I’m  also guessing the picture you submitted wasn’t a recent photo. Same one you’ve been using for the past 6 years? All these combined do not come across as a honest mistake, more like a disregard for the listed instructions. 

 

Unfortunately for your niece, she is deemed personally responsible for the misinformation. She will definitely not be approved. She’s better off withdrawing and trying again. Fortunately, DV2019 filing period is still open. She should put in for it herself and ensures she follows the instructions completely.

It does not matter at all. You submitted the wrong information. She's being single and she's being married are two different people and two different cases. 

 

Sorry to say, but she will be rejected her visa for the false info.

It means nothing. It's your responsibility to check that all information is correct before sending the application. Now she's not going to get her visa because of your mistake. Rules are rules.

Thanks, guys and gals for your humble opinions. this is a messed up situation, I wish I could talk to KCC or to the consular services and explain to them the whole situation. We are human being, no one is immune to mistakes.
