Two (2) months, still did not receive the notice of Request for Initial Evidence from USCIS

Hello Everyone!

 

So, the USCIS online case status said that they mailed the notice of Request for Initial Evidence last September 26, 2017 but until now we still didn't get the notice in the mail.. Even the service request that we made last October 11 reached the 30 day period, so we made another service request (2nd) for them to send us a copy of the notice. It's been almost 2 moths, we're worried that it's going to expire soon.. What's the best thing for us to do to resolve this issue??

Call Them and ask for tier 2 and if you are lucky they can fax it to you otherwise you have to tell them you haven't gotten it. 

 

You have 90 days to respond to a RFE so time is ticking for you.

What's a tier 2? You mean a second level officer?

Yes...when you speak to the first customer service agent, you  ask for a tier 2 supervisor.  Call early in the working day as the queue to talk to the Tier 2 supervisor gets long and by lunchtime they are saying they cannot refer your call.. you may be required to enter your name and phone number for a call back.. take the opportunity to do so, it usually does work!

So, we called the USCIS early this morning and was able to talk to a Tier 2 Supervisor.. Guess what?? She said that they cancelled the Request for Initial Evidence last Sept. 27 and told us that our case is ready to be scheduled for an Interview, no schedule yet though. Which is the main reason why we didn't receive the RFIE letter in the mail for almost two months, because they cancelled it..She said that they will send us an email or a letter stating the interview schedule and she apologized to us. Online case status still says "Request for Initial Evidence"..
