RFE for I-765 and I-131 because of name change in Illinois

Hi guys,

 

I was wondering whether someone had the same problem and can tell me how they solved it.

I received an RFE/RFIE for my I-765 and I-131 today. It states that a review of their records states that my name has changed.

 

"Please submit evidence of this name change which may include a copy of your marriage certificate, divorce decree, or court order showing a legal name change was granted"

I filed everything in my new name and sent 3 original marriage certificates with my application but I assume that those got all clipped to my greencard application as I didn't receive a RFE for that.

 

It also says " If you have changed your name through the prevailing common low on your state of residence, please provide evidence (such as a state issued drivers license or ID) that you are using your new name exclusively and that it has been officially recognized by your state of residence."

I tried to get a drivers license or state ID but was told that in Illinois I cannot get one until I have my work permit or greencard. I did change my name on my SSN card. Should I send them a copy of that? And maybe even a copy of my Verizon bill that shows my new name. I just don't have anything else to send them.

Which part of your name did you change ? Did you just take on your husband's last name ?

If so then yes they likely missed your 3 certified marriage certificates due to being all clipped to the I-485. The EAD and AP apps go to a different place and each has to have its own copy  of the marriage certificate. 

If you changed your first name or last name to something else than your spouse's name then it must go through the court and you must show legal proof of name change and a phone bill wouldn't be enough. So it depends what you changed your name to.

I only changed my last name. I just don't understand how this could have happened because I separately paperclipped all 3 applications together. I will send them another 2 copies of my marriage certificate

When you file for AOS and EAD and AP you must attach one certified marriage certificate with each of the forms and clip each application separate so that you have 3 packets and you mail them all in the same big envelope. Clipping 3 marriage certificates together in one package can result in a RFE. I would mail 3 back with the RFE just in case, it could also be that they got lost.
