Request for Initial Evidence

I got a Request for Initial Evidence.

 

The letter says: “Sumbit an English translation with the applicant’s foreign birth certificate issued by the appropriate civil authority.”

 

Either they lost her birth certificate that we sent or they are asking us to translate her English birth certificate to English. 

 

So does anyone know if they are asking us to submit a birth certificate (because they don’t have it, they lost it, meaning this is a generic verbiage for everyone who didn’t submit a birth certificate) or are they saying the one that we sent, that is in English already (From England), needs to be translated to English.

I got an RFIE last month for the exact same thing, which was frustrating because I know we included the birth certificate in the petition. Pretty sure they just lost ours...

 

We ended up sending another one with a copy of the reciprocity schedule for my husband's home country.

Hmm, I just need to know if I should just resend the same birth certificate or if I need a translation or something else?

In general, I would say 'give USCIS what they want', but translating an English document into English just seems like a mistake they made on the form letter they sent out.

 

This is the State Department reciprocity schedule for the UK that RJandHamid referenced. It indicates the relevant authorities that routinely issue birth certificates for your country. Check that the birth certificate you have conforms to what they expect. Is it a long-form birth certificate?

Thanks, that's helpful, but I'm still a bit confused. This is the same birth certificate that we used during the K1 process. Here's what we sent. So is this a generic letter requesting lost/missing birth certificates from the package, with added verbiage about translations, if needed, or are they saying that we got your birth certificate and it was not sufficient?

As you say, it was accepted for the K1, but this is a different officer looking at your case.

 

I'm kind of surprised that it's handwritten. Maybe a typewritten 'translation' is what they want?

Handwritten is how it was done in the 70s in that location apparently. I’m hoping someone else got this exact RFIE and simply sent the birth certificate again and was approved OR someone got a different message on their RFiE for a missing birth certificate. I will try to call USCIS too.

I'm a UK citizen and applied for AOS this year (January PD) and was approved in June. I had no issues with my birth certificate. Here is an image of a certificate similar to mine

Just wanted to chime in and say I have seen before people posting on this forum about USCIS wanting English translations of English (UK) documents.  I've seen it before.

 

Also, it's possible because it is hand written, they want a typed translation to have a clear and perfectly legible document where no errors could be made reading/inputting/translating the handwriting of the birth certificate.

Thanks for the response. I’m with you, it’s the only thing that makes sense, but still, I’m unclear how I would go about translating it in a way that’s acceptable assuming that’s the issue. I’m gearing up to call USCIS who can hopefully help.

You are good with computers and I'm sure excel.  What I did was basically make a duplicate of my wife's original birth certificate using Excel.  Custom made all the fields, translated wording, etc... everything in excel.  I had a translator sign and date it with address and phone number using the translation stamp visa journey provides:

To ensure all grounds are covered, I hired a translator to translate the English birth certificate to English and certify. This way if USCIS lost the certificate or wanted a translation, they will have both. 

 

For my own curiosity, I still would like to know if anyone falls into either of the following scenarios:

Forgot a scenario.

 

For my own curiosity, I still would like to know if anyone falls into either of the following scenarios:

2. Failed to send a birth certificate with their I-485 and got an RFIE with the verbiage different than "Submit an English translation with the applicant’s foreign birth certificate issued by the appropriate civil authority"
3. Sent a birth certificate in English (not translated because was originally in English) with their I-485 and got an RFIE with the verbiage "Submit an English translation with the applicant’s foreign birth certificate issued by the appropriate civil authority" . Then, resent the same birth certificate without a translation and then got approved.

FYI, English to English. I will update this thread again once the AOS is approved. I know I could have likely pulled this off for free, but as always, when it comes to my best friend in life, I take no risks. These people get 100% USCIS approval.

You do know that the 100% USCIS spiel is just marketing right??  Anyone could have typed up a similar document since it is English to English with no problemos at all.
