Never paid taxes in U.S. and never had a job too

Hi Guys,

 

My fiance and I are really confused and dont know whats the best scenario for us

 

She was born in the US (She has a SSN) and her family moved back to Brazil soon after she was born... She went back once to a vacation in NY with her sister and few months ago we road tripped California together. 

We will get married here in Brazil next year and we would like to move to the U.S to start our marriaged life :)

 

I was born in Brazil

 

We saw that for k1 or cr1 visa you need an affidavit of support of sponsor... I understand that would be for me, as the foreigner. But she doesnt have any form of income in the US either (We are both living in Brazil right now) 

 

What are your suggestions? How can we legally start to proccess to moving to the U.S.?

What is your plan once you move to the US? If neither of you have ever lived here, why is it that you want to move to the US to live? Have you thought about housing, insurance, jobs, education, etc? It's MUCH different to live in a foreign country than to take a road trip or a vacation. 

 

I don't know if she is even eligible, if she has never lived here (I'm sure other VJ members will know) - but I'm curious as to why you think that the US is so great you would both leave your homes (essentially) to come here without family, employment, residence, etc.

Brazilian economy is going downhill year by year... 

We are both young (Mid 20s) and we decided that if there's a time to risk it, it might as well be right now! 

 

we both work with logistics in Brazil and we know that we can be good assets for some companies looking to start or improve business with both Portuguese & Spanish-speaking countries

They certainly wouldn’t be the first US immigrants to do that ... plenty of people who win DV lottery have done it that way.

01/16/2018 %%Received combo card%% (tracking shows USCIS sent it on Jan 11 from MO, then Jan 15 USPS closed for MLK day) 

01/20/2018 Received approval letters for EAD and AP

09/20/2018 Received text 'Interview was scheduled' and interview notice will be mailed

09/27/2018 Received Interview notice by mail

10/25/2018 Interview day

10/26/2018 I-485 case status updated to "We ordered your new card"

10/29/2018 Case Status updated to "We approved your Form I-485"

10/31/2018 Case Status updated to "We mailed your new card"

11/01/2018 My card was picked up by the USPS with tracking number assigned

11/05/2018 Green Card Received 

 

Side note: I turned my maiden name into second middle name. In the combo card, my given name is First Firstmiddleinitial, however on the back of the card, they attempted to list my second middle name.

After the marriage or before, if filing K1, your spouse will need to establish residence in the US. Given your age, you probably don't have the minimum assets needed so she will need a job, etc. to prove her ability to provide as well as prove intent to be a USC and/or find a USC co-sponsor. If you marry and then immigrate, the process will take 12-14 months before you can enter. It's also quite expensive. Check out the guides on the website to learn more.

 

She will also need to back file tax returns. If she didn't work or earn enough during certain years, she provide a notarized document to the effect or file a $0 income tax return. All USCs are required to file taxes in the US and report worldwide income - whether they're living in the US or not.
