My husband and I submitted N400 on the same day, Finger print came for both of us on the on the same day. Interviews came for both of us on the on the same day, on June 23-2017. My husband was approved on the same day and got the Oath Ceremony letter like a month later and became a US Citizen already.

On my interviews I passed the test and got a check mark on “USCIS will send you a written decision about your application”

I Waited a 120 days than called USICS asking for status update who told us that they will update me in a month then they sent me an email saying “the case still under review and I can ask for infopass if I want.

I made infopass and went to the 26 Federal Plaza NY office, Explained it to the officer who was looking here and there on the computer to understated my case and then told me that the officer who tested me actually approved my case on the following day of the test and sent it for another office in Brooklyn (I don’t know way, may be for the supervisor to review) “ I think he said “ for revision” then the officer in Brooklyn took a month to send it back to Federal Plaza office asking for some info then the Federal Plaza officer replied back on October 22nd

Then he told me that I should wait couple of more months. I am really frustrated and don’t know what is going on or what to do. I don't have any bad record to worry about. It is been more than 4 month and I should wait couple of more months? I read some reviews recommending to speak or write to my state senator but some saying it is waste of time. Some saying to take it to federal court …………… Any suggestion? thanks in advance.

I assure you that any legal action, including suing USCIS will take months, as well. 

When did you apply? It says they're currently processing January 17th, 2017. If you applied beforehand, I would submit an inquery online as your case is outside of normal processing time. Outside of that, I would wait and if you don't hear anything, I'd contact my Senators.

considering you are past the 120 days mark :

 

- make a new infopass and mention that you are outside of processing times - they only have 120 days to make a decision on a case afterwhich you can sue them and force them to either conclude and get you an oath date or bring the case to court for adjudication by judge - usually they will move fast rather than go to court 

 

- also, at the same time contact your Congressman asap and ask them to contact USCIS on your behalf

 

- contact Ombudsman

 

Most likely, if you make a second infopass and they have reviewed and approved your case, you may be able to obtain your oath ceremony date at that time....

  • 07/30/2007 After no touches and no other signs we just got an email with the APPROVAL of I130....Thank God !....now what ?

  • 08/07/2007 Case received by NVC and case number assigned :))

  • 08/13/2007 DS3032 and AOS bill were generated

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

  • 08/21/2007 DS3032 and AOS fee bill arive in mail

  • 08/27/2007 paid AOS fee bill
  • 8/28/2007 DS3032 choice of agent accepted
  • 9/3/2007 IV fee bill generated
