Hello! I don't know if anyone have had this situation/experience.

so my fiancé and I had some difficulties the past months and we weren't ready to use the K1 visa.

so it is going to expire in less than a month and we decided is too soon and we want to wait.

 

so at this point where the visa was never used because I never traveled to the U.S. what can be done?

can it be extended or are we going to have to do the whole process all over again from step 1?

if so is a whole new process?

thank you so much

has anyone gone through this?

I read somewhere I believe another forum that you can write a letter to be extended but not sure if that's after USCIS approved it and before the interview or it could be once the visa been granted.

Use it or lose it and repeat the process (or get married outside the USA and go for a IR-1/CR-1 the 2nd time around).

Contact the embassy. They are the only ones who can extend a K1 that's already been granted (if possible, right?)

ill do that. I was almost sure Id have to go through the whole process again, but was hoping it could be a way for it not to be from scratch.

Let them be the ones to tell you the options. Maybe you do, maybe you don't; but it's their word what counts, in this situation.

You should err on caution and fully be prepared to have to start from scratch just in case. The embassy could easily tell you, no go.

 

I don't think I have ever seen K1 visas 90 day time period extended after you have entered the US. In fact, I will do some research as I don't think it is doable.

The OP never entered the USA.  But I agree with the sentiment, be fully prepared for the embassy to say no go.

I concur - contact the embassy and see if they are willing to re-issue the visa. If so, you will need a new medical before they can issue it. It's not common, but this has resulted in a new visa in the past.

K-1 visa cannot be extended even if the Consulate says they can reissue it.  It happened with me, they acknowledge reissue and then 5 months later said they cannot citing some 'Fam' and apologized (at least).  I lost 6 months in the process and had to refile and now waiting over 3 months :)

07/27/17 - K1 packet sent at the end of day.

07/31/17 - NOA1

03/22/18 - NOA2

08/28/18 - expected date for medical completion - Sputum test was needed

09/22/18 - anticipated interview date

What CAN be extended is the time between the foreign embassy receives it and the interview/medical date. My fiance and I did this. We were very much together but no problems, but we were in the middle of a trip around the world together and did not want to finish it early to move to the US. We got our NOA2 much faster than we anticipated (13 days after NOA1). To get that extension, we had to submit tons of proof we were together with to problems. They said okay because we only needed an extension of a few months. I do not think they can extend the actual issued K1 visa after it is issued. If you do reapply, I would assume you would have to go over and above to prove the fact you are still together.
