Hello everyone i just want to ask if i can apply for a tourist/visitor visa i just came back here to my country from USA using a K1 Visa but me and my fiance broke up so i decide to come back home before 90days end, and i am planning now to apply a tourist/visitor visa coz i want to go back to be with my sister and do tour too to other part of USA, my sister is always live alone and she is pregnant and her american husband not always around because of his job, please let me know what to do and if i can apply for a tourist/visitor visa. Thank you so much.

No one can say you can apply - you can apply for one if you want to but you got some red flags.

 

You just showed immigrant intent to the US. 

You just came back and want to go again right away.

You have family in the US.

 

You have to show strong ties to your country that you will return.

The only thing you can do is give a try, but like said it will be a tough sell to prove you will not end up staying in the US.

It also is important how recently your K1 application/entry was. 

 

You can apply. Be sure to show strong ties to your home country and that you will return.

 

It's works against you that you've entered the US previously and didn't complete the visa process. Now you'd like to return to visit your sister, who also immigrated, and is now pregnant and needing help while living away from her spouse. Immigration is going to be curious if you'd overstay or have intent to stay with your sister to help out. You'll need to have strong ties to your home country, especially if it's a high fraud country.

What red flags means? my previous K1 visa, i came back home before 90days end, so i will not over stay, and strong ties to my country what it really means? Like own a property? Yes i own a property here and i have a business too and i have my daughter here too reason for me to come back home if i get a tourist visa.

Did you have all of this before you left for the US with the K-1? Did the daughter go with you on a K-2?

The recent K-1 visa works against your ties as, at least many of them, you were either willing to give up to live in the US or they weren't strong ties to begin with. That said, the fact that you came back without any overstay adds to your credibility, which is important as well. If I was a better person, I'd say your chances are not high, but I 100% would try and find out how it goes. Good luck! Please post back with how it goes.

 

Edit: As an example, is the business a strong tie / compelling reason to return home? You either were willing to give it up very recently to live in the US, or it's a business that you could still run/operate while in the US (so how would it compel you to return home?). I'm not trying to be a downer here, but just trying to explain how it's an uphill argument to make.
