Hello! I’m Coleen and I just had my interview last Nov 6, 2017. I think my case was approved, however I have one missing document which is Explanation letter from the petitioner for not remitting taxes, hence the CO wasn’t able to issue my visa right away. Instead, the CO instructed me to go to the releasing window to receive this 221(g) letter and follow the steps on how to comply on the missing documents. Just a background of my case, the petitioner is my father and he’s unemployed ever since he set foot in the US. So, I have my sister and bro-in-law as my co-sponsors. When I had my interview, the consul wasn’t concerned of my father being unemployed and he was satisfied with my co-sponsor’s ITR and W2. But because I lack the said letter, he had to delay the issuance of the visa and placed my case on Administrative Processing. Hours after the interview, I told my dad to make a letter of explanation and when it was done, I sent it right away to the US Embassy thru 2Go courier service for free (as long as you attached letter). The following day, I got a notification from the courier that the docs had already been received by the US embassy. I checked my visa status online via CEAC, still it hasn’t been updated yet. Not until the following day when I checked again my visa status, it reflected there that my case has been recently updated (Nov 8, 2017). Went all over google to search how long will the processing take and per NVC’s instruction, usually it is resolved within 60 days. Now my concern here is I’ll be turning 21 this January 1st 2018, if I’ll wait for the allotted 2 mos processing, I will definitely age out and I might encounter some issues with the immigration. Is there any way I can “expedite” the processing, knowing my valid reason? Or has anyone here had gone through the same situation as I did, and how long did your processing took? I heard it would range from 3 days to 5 weeks to months and I couldn’t afford to wait for further because of my age. Huhuhuhu! Please anyone? I need your thoughts on this. I’m really anxious right now.

Did your sister list Dad as a dependent on her taxes? If so, that would mean your Dad would  not have to file. If not, just have your Dad file back tax forms for zero income for the past years he has been here.

Yes, Maam/Sir!! He was enlisted as dependent in my sister’s ITR. Plus, it was also stated on my affidavit of support the reason why he’s unemployed and who’s co-sponsoring me and the agreement between them. The consul didn’t asked me further questions about it tho, he just simply told me that I lack one document and that is the explanation letter.

Hi,

From my reading of your message you have a concern about "aging out."  As long as the petition(s) has been started and is currently "in progress" or however the USCIS puts it, before anyone listed on the petition turns the appropriate age, 18 or 21, "aging out" should not be an issue.

Is that so, Sir? :o I would be so much relieved if that is the case, because when I scanned through the pages of USCIS, it has stated there that we have to inform NVC that I will be turning 21 soon so that they can expedite my case because I might encounter problems in the immigration if I age out. But anyway, that is prior to interview. I’m not sure if the same applies for administrative processing.

Hi Coleen,

Review CSPA act which explains on "age out".  If your father is permanent resident and if your file is pending in USCIS for sometime then you can add that time to your age so for ex. if file was pending at USCIS for 7 months then your age will be 21years - 7months.

 

My sister has similar scenario where our dad is not working and I am co-sponsor, her interview is scheduled next week, can you please share your interview experience? This will help her reliving stress.

Hello, sanz! Thanks for sharing your input. Yep! Somebody already told me that I don’t have to worry with regards to “aging out” because I’m already in the last step in my petition process, plus I am still protected with this Child Act Law, so it wouldn’t be of concern anymore. Anyway, as to my interview experience, it was all good. Both the Filipino and American Consuls were nice and friendly. They would only ask you some generic questions like “Who is your petitioner?”, “who’s co-sponsoring you?”, “when was the last time you saw your petitioner?”, “what does your co-sponsors do?” And etc. Just tell your sister to smile and be courteous all the time because I think that would also help in creating a positive atmosphere. Also, it’s important to have all necessary documents ready On the day of her interview so that she will not have any reason to be nervous about. I guess that’s it. And oh, will she be having her interview at the US Embassy in Manila? If so, I suggest she should go as early as 5:00AM so that she’d be the first one in line (bc if that’s the case, she’d be done with the interview in less than 2 hrs). I think that’s all! :) i hope that helps!

Hi there!! For those who are wondering how’s my case going...

 

I JUST RECEIVED MY VISA TODAY WOHOOOO!!!! And I’ll be leaving for US in the 22nd 😍

 

anyway here’s the timeline of my IV Case

 

Sept 30- received the interview letter from NVC

Oct 10-11- had my Medical Exam at SLEC and got the results on the 2nd day

Nov 6- Interview at USEM in MNL and my case was placed under Administrative Processing. And on the same day, I sent all lacking documents to USEM

Nov 8- USEM updated my case, but still on AP

Nov 14- USED updated my case and ISSUED my VISA

Nov 16- 2Go courier notified me that the docs had been forwarded to them from the Embassy

Nov 18- Arrival of docs to CGY (as notified by both 2Go and US Travel Docs) and picked it up on the specified 2Go outlet

 

so there ya go my Visa Timeline!! All my prayers had been heard and I am beyond grateful for this blessing!! TO GOD BE THE GLORY 🙏🏼
