They don't require anything extra at the interview above the original submission.

I suppose they could ask for more than one year of returns, but there is no need to bring more information than what you submitted when filing.

Rebecca, on the I-864 I filled out it required the last year's tax return only (which is all I submitted), the extra stuff was optional. On my interview letter it said "Bring the last 3 years tax returns". I assume the items listed on the interview letter are a requirement, so I think you're mistaken here.

BTW - I see from your timeline you're almost there! :)

My husband submitted his 2006 return with all corresponding documents. However I'm a bit worried if we get an interview- we have a 2005 transcript but he didn't work in 2004 because he was applying to Grad school...so no return in 2004. What evidence would they want to see to justify the absence of a return in 2004?

Mine lists 3 years tax returns, employment letter, 2 months of pay stubs and says "failure to bring any of the listed items will result in denial"

Alright, do we have anecdotal evidence of recent interviews wherein petitioners submitted only ONE tax return with sufficient income for the I864?

And if so, did the AO ask to see prior years?

The Field Manual for the I864 has very specific guidelines to the AO regarding tax returns. (I would post the link but it's bookmarked at home and I don't have time to hunt for it here at work.) They are specifically instructed that if the income for the most recent tax year meets the minimum requirements they are NOT to request any further documentation.

My interview is today, so I'll let you know but my mom made more than enough (joint sponsor) and for the interview they still want all 3. SO we'll see if they ask for all three (if they do, I have four. HAH.)

Good luck to you today! You know, these things usually go swimmingly and we all know that, but I remember being just a bit nervous about having our relationship 'up for examination'.

I only submitted 1 year tax return with I-864 and they didn't ask for more, my comment about it being required was purely based on the statement on the interview letter. Still what else can we do but follow the instructions USCIS give us! :)

To the OP. I was concerned also and sent the last 2 years and did not get RFE'd. Just recieved our interview letter that clearly states you will need the last 3 years tax returns so you might as well get them ready and send them now. Don't forget to make duplicates of EVERYTHING. We did and now we are ready to go for the interview.

The giudance ('regulations') is there for a reason.

AO's always have the proviso 'totality of circumstance' as a place to hang there hat insofar as requesting additional information. But they must show good cause for such.

Precisely. It's always, always, always best to be completely prepared...but...more often than not, we are "over-prepared". Our AO didn't ask to see any paperwork whatsoever :blink:

I just visited the US Interests Section March 2008 to ask some questions.

The woman I spoke with said that they are looking for evidence of my ability to financially support my fiance/spouse, as well as his history of and ability to work. They don't want someone who comes in with a future of going on welfare or food stamps, etc.

So I said I didn't have my most recent taxes done, but had the past 3 available. She said the taxes were not specifically required for the K-1 Visa interview, but the Affidavit of Support should come with some evidence of support. I have my salary letter plus copies of some bank accounts. She said that would be fine.

I see however that some people say that later in the process (AOS) that they do specifically require tax history. But for the K-1 Visa interview in the person's home country, the Affidavit of Support should come with some documentation that you are stable and can offer the support needed to keep your fiance off the public welfare system.
