Someone correct me if I'm wrong here. I believe you only need the 2006 tax transcript. Some of us go with the "better to be over prepared than under prepare" approach. For example, myself. This is what I'll be sending. Will they need all of this? Nope. Why do I do it? To be over prepared and just in case and so on. This will also show them I have a steady income.

What I'm sending:

IRS Tax Transcript For The Past 3 Years

Tax Returns For The Past 7 Years

W2 For The Past 7 Years

That's just for taxes alone. My pay stub is from August 2005 to present.

Yes it's necessary to turn in 3 years worth, if you do not have 3 years worth than I'd recommend getting IRS transcripts.

We only submitted my 2006 returns as well as the IRS tax transcripts. I read that the I-864 only requires the most current years tax return unless you are self employed. That's what I sent. So far so good...we were transferred to Cali.

We gave them copies of the last 3 years of returns only. No transcripts.

No its not necessary. Only your last tax return is necessary for the AOS application. Sending 3 years of tax returns is optional.

However, 3 years of tax returns is required for the AOS interview.

This is a good idea, but not a requirement of the I-864.

Oh yes definitely not a requirement. Only the most recent year is required as you stated. I just like to cover all my bases. :P

hi, My USC wife & I (UK Citizen) are thinking about filing a I-130 for a IR-1, and almost got everything together barring the US Style passport photo's.

I've had a scan through what is required to be provided for the IR-1 and it all looks pretty straight forward, apart for her tax returns. As far as i know (and i "could" be wrong), but for the last 7 years she hasn't been filing her taxes (she seems to think she doesn't need to as she isn't earning enough here), i know she had tax returns for the years up to and a year after moving to the UK, but nothing after. Will this be a problem when applying for the IR-1?

No its not necessary. Only your last tax return is necessary for the AOS application. Sending 3 years of tax returns is optional.

They don't require anything extra at the interview above the original submission.

I suppose they could ask for more than one year of returns, but there is no need to bring more information than what you submitted when filing.

I only plan on sending my tax return and W2s for 2006. I have the returns for 2005 and 2004 but the I-864 makes it quite clear that they are optional. My salary is enough that I do not need a co-sponsor so I don't think there is any reason to worry.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

Rebecca, on the I-864 I filled out it required the last year's tax return only (which is all I submitted), the extra stuff was optional. On my interview letter it said "Bring the last 3 years tax returns". I assume the items listed on the interview letter are a requirement, so I think you're mistaken here.

BTW - I see from your timeline you're almost there! :)
