well here is the situation

I am going to correct my tax return and file as married filling jointly.....the question is my husband is planning on going back after entering the states for work reasons he wants to stay here about fourty days and go back now here is the problem

if he stays with me 40 days he will end up paying double tax on his income for this 2007 year ...do you think if I file as married filling separatly this will solve our problem

and he wont have to pay tax on his income twice :wacko: i am not sure if I am making any sense right now but i surely hope someone out there knows what I am talking about and would help

No, he won't end up paying double tax. Not if you and he read the instructions for reporting foreign-earned income.

Filing married-separate is not the solution - that very likely will cause you to pay more in taxes than you should need to.
