Hi ,

This question is old but ... I still confuse if HCMC accepts Tax Transcript over 1722 ? I am about to resubmit Tax transcript plus other documents as CO requested. Thanks.

what are tax transcript and 1722 ? Can I give them the papers I got from the tax office ? or I have to get them from IRS website ?

Thank you, my fiancee interview is cumming, i guess .

I-129F sent and recieved by USCIS on Feb 16th, 2007-Also I fly to Vietnam to see my fiancee on today. This is the 4th times I have flied to vietnam within a year time frame. I miss her.

Oh no.....Kevin and Loan..they accepted a 1722 with you guys? I wasn't so lucky.

Here is a copy of email correspondence I had with the Consulate.

To whom it may concern -

My fiance brought additional evidences that were requested by the consulate on Thursday. She had her interview on January 4th 2004 and amoung the items you requested were my (petitioner) tax statements from 2003. I have sent in my 1040 and my fiance had form 1722 with her at the interview. When my fiance brought the evidence to you Thursday, the office there told her that my W-2 was missing. The following is word for word the request you made regarding tax forms.

Your petitioner must submit tax records and W-2's for the year (s) 2003 or form 1722

The letter says that I could send W-2's OR form 1722. I have sent 1722. It is in your file now. My fiance had it at her interview. We do not understand why you say I am missing W-2's when you have 1722. Below is the entire letter.

IMMIGRANT VISA SECTION

U.S. CONSULATE GENERAL

HO CHI MINH CITY, VIETNAM

Dear :Pham Thi Bach Yen CASE # :HCM #######3

The Consulate General is unable to issue a visa to you because you have been found ineligible under the following section(s) of the U.S .Immigration and Nationality Act :/

Section 221 (g) which prohibits the issuance of a visa to anyone who is not eligible for a visa , or who has failed to present the document required in connection which the visa application , or who has failed to sufficient credible evidence to support the claimed petitionable relationship. The following remarks apply in your in case:/

* Your petitioner must submit tax records and W-2's for the year (s) 2003 or form 1722.

* Petitioner - Please provide a DETAILED letter of explanation regarding EVERYTHING listed below :

n How , when and where you first met (please give details : location , setting , people present , how long until accepted (right away , a day ,a week , a month ?....)

n How , when and where you were engaged ( who came , location , setting ,time )

n How ,you developed your relationship

n What you have in common

* Petitioner - Understanding you used phone card to communicate, please submit all phone bills during the period form October 2003 to November 2004.

* Please have Petitioner send a 5 minute video tape speaking unscripted Vietnamese (or as much as possible ).

WARNING : IF YOU FALL THE ACTION REQESTED OR FALL TO PRESENT ADDITIONAL EVIDENCE SUFFICIENT TO OVERCOME YOUR VISA DENIAL UNDER SECTION 221(g) OF THE IMMIGRATION AND NATIONALTY ACT WITHIN ONE YEAR OF THE DATE OF YOUR INTERVIEW, SECTION 203(g) OF THE ACT REQUIRES THAT YOUR APPLICATION BE CANCELLED.

A short timeline:

October 2003, Introduced to YEN by her cousin whom I work with. We like each other etc etc etc..and so on

February 3, 2004, I go to Vietnam to meet her. Things go well so on

February 9, 2004, we get engaged and have the big ceremony and then on

February 14, 2004, I get back on the plane and come home. By about the middle of May I have everything ready to send in to USCIS for the I-29 and on

May 18, 2004 the Nebraska service center recieves the petition. And on

August 28, 2004 I recieve approval notice from NSC. On

October 18, 2004, Yen recieves Packet 3, fills it out, turns it in and on

December 13, 2004 Yen recieves Packet 4, she takes care of it, does the medical etc etc and the interview is scheduled for

January 4, 2005. Yen arrives for her interview and FAILS! So I call and find out what went wrong and they require additional evidence including a 5 minute video of me speaking vietnamese, a tax document that was already in the file, and some letters from me about how and when we met, when and where the engagement was, things we have in common and how our relationship progressed. So on

February 25, 2005 I go back to Vietnam to visit my em oi and on

March 2, 2005 she and I go to the consulate to give them the Video etc. They tell us to expect to wait another 2-6 months. I decide on

March 10, 2005 to give the consulate copies of my airplane tickets, visa and ticket stubs for Yen and I's trip to Phu Quoc. Unexpectedly on

March 23, I get an email from the consulate telling me that our case is APPROVED! So on or about

April 25, 2005 Yen arrives in Kansas City, MO, USA!

Now going through the rest of the process here.

Yes, I did used the tax return transcripts and the Consulate never raised any problems. I guess I was lucky. I wrote them for their confirmation before I sent the transcripts in though.

According to the info I got from IRS, a "tax return transcript" is a computerized printout that shows most line items from the federal tax return (Form 1040EZ, 1040A, 1040, 1040NR, 1040NR-EZ, 1040SS, and 1040PR) as it was originally filed, including any accompanying forms and schedules. It does not reflect any changes you or the IRS made after the return was filed. In many cases, a tax return transcript will meet the requirements of lending institutions such as those offering mortgages and student loans.

I used to be indecisive. Now I am just not sure ...
