Newbie, possible missed documents

Hello, 

 

I would like to thank everyone in advance for looking into this thread and letting me know how to go about this.

I filed my i130 for my spouse outside the U.S

When I filed I did exactly what the uscis site said and I called to make sure I was filling out the right forms.

Now, I have been doing constant research and saw the timelines on this website which were very helpful.

My question is, did I have to submit a affidavit of support with my i130?

I ask this because when I called uscis, they said I didn't need to.

If I need to submit it... can I? how does it work? 

If don't need to submit it and they ask for it, how long of a delay would it cost me?

 

Please let me know how to go about this...

The Affidavit of support is only required at the NVC stage ( after the petition has been approved).

Exactly.  They will ask for them when they are ready.

USCIS doesn't ask for it. After they have approved the i130 petition, the case is sent to the NVC - which are under DOS  they will ask for it.

USCIS is only concerned about adjudicating the case. Then if they are satisfied, they will approve and forward the case to NVC (National Visa Center/Dept of State). NVC will provide you a list of the documents (including the Affidavit) they will need in order to process the case. So you dont need to worry about that now.

 

You may want to however check to see if you may need a joint sponsor and get that sorted out so when you get to NVC you are ready to send the required information as soon as they request it, to cut down on the lag time and reduce the stress in having to find someone last minute.

If you want to know if you missed anything, study the I-130 instructions and see if anything listed there was missing from your package.  You don't know what you don't know until you've read the instructions.

Facts are cheap...knowing how to use them is precious...
