K-3 is obsolete. Only 102 were issued all last fiscal year versus the ~130,000 CR-1/IR-1s. USCIS policy is to adjudicate the I-129F and I-130 together. NVC policy is that if the I-129F arrives after or at the same time as the I-130, then the I-129F is administratively closed. Recently, USCIS has even been closing them directly once the I-130 is approved.

I think you're referring to the I-130 timeline? Then there's NVC processing + embassy interview scheduling. Those two items can add ~6 months to the process after the I-130. The average from filing to interview is 12-14 months, and tends to be trending even longer.

@MichaelAndAlicia do you have an EU/UK passport or right of residence in the UK?

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

This is simply incorrect. If you follow the Nebraska service center thread where the vast majority of CR1/IR1 filers are sent it is 9-10 months right now just for the i130 alone. When I first started the process i130's were only taking 5-6 months. However, the backlog at USCIS is getting worse and worse. I am not sure why USCIS took California out of centers to process regular i130's but they did. If a person is so lucky to get Potomac they might get finished the i130 process in 6 months. Vermont isn't processing very many i130's and Texas is probably closer to 7 months for a i130. I shudder to think where i130's are going to be in another 6 months. There is a serious problem at USCIS that nobody wants to deal with.

 

You add in NVC and Consulate processing and it puts the person well over 12 months. I think it's better to be honest about what the person will be dealing with. I was one of those people when I first started this process who thought immigrating from Canada I could get through the whole thing in 10 months. It's been over 9 months and I don't even have a i130 approved yet. I have been together with my spouse for over 12 years. We have been through many trials and tribulations but our relationship no doubt has been tested. What is going to make things difficult for this person is the back and forth trips to visit one another. I can speak to this as I do so every 7 weeks or so. I also deal with the border because of my own immigration situation. I have to explain what my current situation is and show proof of ties. It's a hassle and it's stressful because every time I enter the US I have no idea if they will let me visit.

 

The expense of this process is also trying. Having to pay for one place abroad and another place in the United States. If we had the option we would've gone the DCF route without a doubt but Canada does not offer it. I found once I got to 9 months of waiting things have become really difficult. I try not to be a needy person either. It's just tough to have a marriage when both people are living countries apart. You crave having a normal living situation. Unfortunately for this couple AOS will likely no longer be an option as it would be very obvious they had an intent to immigrate.

 

I would honestly assess the likelihood of success and whether it is worth to go through this process.

 

To be honest it's a thousand times easier to immigrate when you are just boyfriend and girlfriend. You don't have to go through the same kind of 1 yr separation as when you are married.

it took us only 6 months with the K1. wow.

 

so even with approved i130 and CR1... his adjustment of status probably wouldnt be approved later?

K-1 is taking 7-9 (or even 8-10) months now...the processing time there has shrunk and grown drastically in recent years.

 

A CR-1 visa doesn't do AOS. They get permanent residency upon entry.

Well, they can't go back to being boyfriend girlfriend. They are already married. According to visa processing timelines for different processing centers it is taking about 6 months for I-130 approval and let's add another 3 to 6 months for NVC and visa processing stuff, so yeah 12 months is possible, but hope for the best and it might happen sooner. I know this is tough. I am going through the same process right now.

same type of situation where you left? or just the waiting game on immigration?

 

we are supposed to have a talk today about what we want. we'll see how it goes. it's been almost 3 weeks and it's getting to a point where a decision needs to be made. 1 month to let the dust settle. business or no business.

You neglected to mention it here, but I was looking back on the forum and noticed that he also abandoned his new step-daughter as well, yeah?  I'm going to give you a little unsolicited advice woman to woman, especially as one who has a child from their first marriage... do not have children with this man and guard your daughter's heart.  Men who leave children always do it again.

mm yes but I do have to add that I am no angel LOL

 

my attitude is poor and I get stressed out after work (work in a childrens ICU)

 

he's not fully the bad guy BUT the leaving on no notice at all was just... what... at least tell me. don't surprise me when I come home from work with my keys in front of the door :( even if we did have fights about him going home. I did deserve to know.

lol I'm not looking for professional counseling on this website. The goal of posting on here about it was to see if anyone else has gone through the same thing and what they did to get someone back over here
