No.  You will have to adopt her to become her legal guardian.  I will have the same issue with my fiancee's two kids.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

I believe the only way to "officially" become her legal guardian is to adopt her.  Since she is an adult and the process is expensive and lengthy, I would talk to a lawyer about what specifically you are looking to accomplish.  Mine are 17 and 14 and we haven't seriously sat down to talk about it.  The 14 year old wants me to do it but the 17 year old is the last of his father's bloodline and doesn't think the father will want him to change his name.

You can't be the legal guardian of an adult. 

As you don't mention anything about her being disabled then no there is no way. 

She's an adult, you can still add her to your health insurance, car insurance and all the stuff parents do. But you will not have any type of power of attorney over her even if you adopt her. She is an adult and like every other adult she can do as she pleases.

To get in state tuition costs Penn State says they need proof of me being her legal guardian , since I'm the pa resident , I guess there is no way for her to be legal resident until she can gain full residency ?

Well, her mother is living with you, correct? That will make her a PA resident too and she can show she is the legal guardian of her daughter.

Ok this is because they are trying to use your residency to avoid the waiting period for her. Some Colleges it's 6 months residency others it's a year.

So whatever they have set as minimum set up she doesn't meet it yet. They want to use yours because you lived there longer, ask them what they want. Maybe your marriage certificate to her mother or having her on your health insurance maybe good enough. If you've been married long enough to have filed taxes and claim her as a dependent that would work too. 

 

She just needs 1 yr residency in PA to get in state tuition.

There's a minimum amount of time they have to live in PA before she qualifies for in state tuition. Her mother would not meet that requirement either. That is why they want something from him.
