I'm telling ya!!! I been through cancer n this has me a million times more stressed n worried .. I love my husband's country, lived there for 2 1/2 of our 5 year marriage... But I want our children schooling and raised here ..

I hope you have beat your cancer and stay cancer free, you defiantly dont need extra stress from this.  Thru this whole process i wanted to just call and tell them to come live with us for 24 hrs lol.... incompletely understand about your concern for schooling and being raised here. I agree 110%.    Dont worry you got this :)

as I recently posted, we got a RFE notice online and reviewed offical copy today in the mail... It says they recieved :

-Our daughters birth certificate

-first page of lease (with address and our signatures)

-first page of H&R block showing tax preparation

-letters from other parties

-prescription label showing and expected birth of a child (we lost the child at 4months pregnant)

 

Obviously, since receiving RFE they were not satisfied..

these are the things I've collected to send with RFE package:

 

-Copy of both of our drivers licenses with front and back view

-His employee info sheet with me listed as husband emergency contact

-His 401k with me listed as beneficiary

-His union health insurance with me listed under the plan.

-Copy of life insurance policies with each other listed as beneficiaries.

-Copies front/back of our insurance cards

-2018,2017,2016 tax years 1040s with 2018 W-2s (can't find other years W-2s)

-2 years of our bank account transactions and statements

-1year of credit card transactions and statements

-Letter from landlord saying we have occupied or rental and paid rent on time

-copy of lease with all pages

-consumers energy bill (electricity) in both of our names

-trash pick up bill in both of our names

-statement from State farm insurance with our address and us both be drivers on the policy

-state farm bill addressed to husband with it showing him paying disability insurance on me as well as homeowners/rental

-His student loan with our address listed (his name only)

-tons of pictures 

-2 more affidavits

-letter from OB stating I'm scheduled for C-section on the 19th of April

 

we didn't have many of these the first time ...we were just getting settled and starting a family ... Is there anything else I should send .. we don't have many bills in both names and or vehicles are registered to either him or i . 

 

btw my husband is the one who is filing to remove restrictions... I'm American born citizen. Someone please help us!!!!!

 

 

 

All this are perfect ! For your joint tax return please don’t forget to print out the original transcript from the it’s website . Not the h and r blocks gives you .

 If there’s any positive way to look at it is at least they’re doing the next step which is an interview and not denying it out right,

if you don’t mind me asking what did you submit with your original application and what were they looking for in the request for evidence in what did you send them back just trying to see what it is that made them ask for an interview

The RFE was very generic, basically send them everything again (proof of shared residence, shared financial responsibilities,  affidavits, ect.). I've sent back fresh bank statements, bills, car insurance, health insurance, credit cards, beneficiaries forms, 2 years of joined tax returns, for 2017 we filed "married, but filled separately", 2018 I didn't even file yet. I've already submitted 5 affidavits originally,  so didn't add any more with FRE. For residence, I've submitted leases for last 3 years. We recently bought a house, but it's only on my name, so I didn't submit anything about that. Also, got copies of our driver licences and cards where we changed address. I guess in their minds that's not enough. I'm trying to keep it together...just don't understand why it has to be us...

Did you give them an explanation on why you filed married, but seperate?   This is the only thing to me that they might want to question.   Everything else you sent was very strong evidence.     I know you are frustrated, trust me i know hang in there its almost over.  Just prepare well for your interview.  I think you will be ok.  Btw our RFE was the same as yours. Send everything in again that i had sent.  I think they do that for the dates, because so much time had passed since we originally sent the application in.   They were looking for tax returns from us ... but i provided proof of why we havent filed together yet.

No, I guess that's the only thing, I didn't give an explanation. It was a long story, but basically it was because of my husband's child. Child lives with my husband's parents and they wanted a particular school for her. My husband had to file under their address because that's what the school required. I guess we'll have to explain that during the interview and we'll be on our way.  Thank you for your kind words! I see the end of this long dark tunnel, just need to hold on a bit.

Yes, im thinking this was the issue.    Yes just explain that make sure you bring any proof possible to back that up

Now I am scratching my head.i just send back response to rfe last week.Dont see any status that they receive it yet.My case we didnt file joint either.

@vvp   If I were you I would also get affidavit an from where the child is living stating from that person it is true why she’s there  & why that address is being used for your husband for his taxes  dont worry.  You will be ok :)
