Actually, there are a fair number of older filers who waited because they didn't want to submit a bunch of evidence again... it just seems with the current processing times that more people are considering the 3 year.  

 

Yeah, it was 4 months for ROC 3 years ago.  It seems processing times on everything has increased, N-400 in our locale has gone from 6 months to over a year, and I-129fs and I-130s are also taking almost twice as long.   I'm not sure what USCIS's excuse is without the DACA one they were using a while ago.

I appreciate that my case appears to be far from normal, but I just find it baffling how one can get a CR-1 from start to finish in around four months, yet ROC as an existing permanent resident who completed all the checks required before, is so far clocking in at 2.5 years, and so far is MORE expensive than the original I-130 & CR-1 combined.

 

2 x I-751s, 2 lots of biometric fees and soon an N-400 and another biometric fee, all in the space of three years!

 

Even someone with a 'normal' I-751 waiting a year to eighteen months is no way acceptable..

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

A year for the N400, please tell me you are kidding?  Wow, at least they are consistent!

I totally agree with you, I use an app on my phone and it shows me so many CR-1s that have been approved months ago, but have the same date as my ROC application. How can that be when they have all the new checks and such. I guess it has to stem from the pressure they got a couple of years ago when it was on the news how long it was taking to reunite families.

I often have a little laugh that my actual approved I-130 just took a single day for London to process.  That is actually how long it takes if they aren't sitting in a box.

I think it is 14 months according to what I've seen.  That varies by local office.  Our office handles 3.5 states's petitions.

From rusty memory, I think the original I-130 was back and approved in around a week from sending...

Exactly what was the rationale behind the fee increases last year? 

 

And, were any promises made about processing times?

What I read a few months ago and I don't know if there is any truth in it  part of the fee increase was due to them spending millions on the computer software so we could file N400 in a quickly and timely manner.

Not likely since them refusing to accept the documents or not hiring you based on the lack of a 10 year card would be illegal. There are exceptions for some types of positions (federal agencies, civil servants, etc.), but I don't think a city's fire station would be one of them. This is really an issue for you and the employer to work out, or to escalate it to a complaint against them.

Fees went up Dec 2016 but wait times have increased. What a scam! 

That kind of policy might result in quicker ROCs, but that would come at the cost of another process being slowed down instead (I-130 for relatives, I-129Fs for fiances, N-400s in general, etc.). It would just result in shifting resources from another process to ROC...not overall faster performance (since it's a stick without a carrot).

The fee hike was the first increase in 6 years, which is used to cover the increased costs of adjudication of an individual petition/application. It was not intended to speed up processing of each application or to cover a backlog...although some funds are dedicated to improving the technology and workflows, but that's always the case/goal (and looks like it mostly was focused N-400 processing).

This is a very interesting topic for me as well. I have applied for a military position that is open to permanent residents. I let them know in advance that I am going through the removal of conditions and that was acceptable to them for me in order to apply but now that I actually have been offered the job I can not start the next steps without being able to present the new green card and as I have only been waiting for 7 months, that can take a while.....I wrote to my senator who requested an inquiry to uscis which is a start but I doubt they can really speed the process up, or can they ?

 

Apparently the military personnel that I have been in touch with will also send a letter asking for my petition to be processed faster, but I am not sure if it will change something. 

 

I feel so frustrated, as I want to serve the USA and am considered qualified to do so by the military, but just can not get the process started.

https://www.uscis.gov/forms/expedite-criteria  I don't know if you fall into this category apparently there is a military USCIS line,  they may be able to help you, it's a long shot I know but worth a call.
