CRBA cert. for child of US citizen and indian citizen

Hello all, 

 

I am a US citizen and my wife is an Indian citizen. Right after she received her CR1 visa  she gave a birth to our biological daughter. She was not able to fly before delivery per doctor's instruction. We are apply in for CRBA for our new born so they both can migrate to the US. 

I am being little paranoid because I have heard of cases where people get denied and if that happen to me I am doomed since my wife visa expire in Feb 2016. Also, I am not going to be present at CRBA interview because of multiple reasons. 

 

Does anyone here have any experience filing CRBA at Indian embassy. Please let me know

I  don't have experience with this, but I think it will help that the child was born while you were already married. It would probably be a lot more difficult if the child was born out of wedlock.

 

Also, do you mean your wife's visa expires in Feb 2018?

Yes our daughter was born in webdlock 

 

my wife cr1 visa expires on February 2016 

As I said she recently got cr1 visa couple week before my child’s birth

Yes she was born while we were married.

Yes she was born while we were married. 

 

Yes got cr1 visa right before she gave birth  she was unable to travel so she stayed there. We only have couple month to process this. Until feb 2018
