Questions I came across filling out I-485

Timeline

So I downloaded the form from the USCIS website.  It is the current form.  So far, my questions are:

 

Part 1, #19. "Nonimmigrant Visa Number from this passport"

-What number is this?  I'm looking at my wife's K1 Visa and I see the passport number, petition number, and the Control Number.

 

Part 1, #23.c.  Status on Form I-94 (for example, class of admission, or paroled, if paroled)

-My wife's Class of Admission on her I-94 is simply:  K1

But, the form will not allow numbers for this entry field.  Only letters and spaces.  What did you guys do here?

 

Part 1, #25.a.b.c.  "Provide your name exactly as it appears on your form I-94 (if any).

-My wife's form I-94 has two fields for last name and first name.  This question on the I-485 has fields for First, Middle, and Last.

On my wife's I-94, since there is no field for middle name, the I-94 is written in with her first and middle names in the "First Name" entry field.

So, on the I-485 do I enter in the "First Name" field her first AND middle name?  And leave the middle name field blank?  Technically that's how it shows in I-94, no?  Or should I just fill in middle name in middle name entry field on I-485 even though I-94 doesn't have middle name entry field.

 

Part 2, #3,4

-Principle applicant is my wife, who is applying for AOS.  Correct?  I fill this part out right?

So would underlying petition be the I-129F?  So my receipt number is the WAC #?

Also, Priority Date?  It is left blank on my NOA2.  Do I leave it blank on I-485 or do I use the NOA2 Notice Date?

Hi, thanks for response.  I actually am following that guide, but that guide doesn't answer questions I have.  So I thought it is best to post what my mind is wondering.  For example the guide says to input "K1" into a field that doesn't allow numbers, so it obviously isn't 100% full proof.

 

1.  I did find the RED Visa number on my wife's Visa.  Thank you.  The guide doesn't specify if the Visa number is the RED number or the control number.  I did not know.

2. This entry field doesn't allow numbers.  I can't write in "K1".  I'd hate to deviate from what the I-94 says.  I can't believe this passed USCIS quality control. 

3. The surnames isn't an issue.  It was the First and Middle names that halted me.  I broke it out on the I-485 and wrote the first name and middle name in the appropriate box on the I-485, even though I-94 doesn't show it separated.

4. This one confuses me.... why blank?  Is my wife not the principal applicant?  And is the I-129F not the underlying petition?

Also, another question.  Under the section of providing previous addresses and employments.  To satisfy 5 years worth of history for both of these questions, we need to use Part 14 Additional Information.  But what part number and item number do I write in?  Reason I ask, is I'm not extending a current address that I didn't have room for, rather I'm creating a brand new entry.  So do I use Page 4, Part 3, Item 7?  Even though I'm technically not adding to Item 7.  I'm really creating a brand new item.  But next sequential numbers can't be used.  :(

2. You can just put "nonimmigrant fiance visa holder"

 

3. Type in how you typed it in the k1 petition form you initially made (or what is reflected on the applicant's passport)

 

4. Yes the one who was petitioned on the k1 and who is now filing for adjustment of status is the principal applicant. The underlying petition is the WAC# and with the priority date I put in the date when the k1 was approved (notice date of noa2 usually) 

 

For additional items i believe you can attach a separate piece of paper with the info you want to add. Make sure to label them correctly

Thanks for responses.  Did a little researching this morning (slow day at work :P )

Both those links (though answered by same person) say the K1 Priority date is the NOA1 Notice date. 

And, as we already know, the underlying immigration petition is the I-129F.

So I think this portion does need to be filled out and not left blank?  Seems to be some people that do and some people that don't, so I guess it's not terribly crucial.

 

I like thinking out loud and discussing things with people.  I'm sorry if my questions seem trivial, but at a moment like this I'm over-analyzing everything to hopefully make sure our GC process goes as smoothly as possible.  I like having dialogue.

 

Still little confused on what to put in Part 14 Additional Information when I need to add additional addresses.  Right now on Pg 14, I just Put: 

Page Number: "Page 4"

Part Number: "Part 3"

Currently have "Item Number" blank. 

But after reading this thread:

I understand your confusion with the Additional information part! It was worrying me for days (literally!) and finally I just put the part and page numbers and left the item number blank. I honestly doubt they'd return a petition for this.

05/24/2017 Entered the US on a J1 visa

11/07/2017 Received email and text notifications about all 4 forms

12/15/2017 Interview notice - interview is scheduled for January 19th! Holy #$%^ that's less than 3 months from PD!

When entering in the Past Employment of past 5 years on the I-485.....  do we disregard time frames of unemployment?

 

During the I-129F process, on the G-325A it was advised not to leave any time period unaccounted for, even if unemployed.  So we listed the unemployed time frames.  Do we do that on the I-485 as well?

You have to account for all time in the past 5 years : school, work, unemployed, self - employed....

The Middle name field should be N/A is she doesn't have one - Reason is - when the form is scanned in the system, the scanner may erroneously read different characters in the blank field -

  • sending I130 05/16/2007
  • cheque is cashed on 06/11/2007
  • NOA1 in mail 06/13/2007 (who said 13 is badluck )
  • 07/30/2007 After no touches and no other signs we just got an email with the APPROVAL of I130....Thank God !....now what ?

  • 08/07/2007 Case received by NVC and case number assigned :))

  • 08/13/2007 DS3032 and AOS bill were generated

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

1.  I did find the RED Visa number on my wife's Visa.  Thank you.  The guide doesn't specify if the Visa number is the RED number or the control number.  I did not know.

2. This entry field doesn't allow numbers.  I can't write in "K1".  I'd hate to deviate from what the I-94 says.  I can't believe this passed USCIS quality control. 

3. The surnames isn't an issue.  It was the First and Middle names that halted me.  I broke it out on the I-485 and wrote the first name and middle name in the appropriate box on the I-485, even though I-94 doesn't show it separated.

4. This one confuses me.... why blank?  Is my wife not the principal applicant?  And is the I-129F not the underlying petition?

Also, another question.  Under the section of providing previous addresses and employments.  To satisfy 5 years worth of history for both of these questions, we need to use Part 14 Additional Information.  But what part number and item number do I write in?  Reason I ask, is I'm not extending a current address that I didn't have room for, rather I'm creating a brand new entry.  So do I use Page 4, Part 3, Item 7?  Even though I'm technically not adding to Item 7.  I'm really creating a brand new item.  But next sequential numbers can't be used.  :(

In regards to your question 3, I saw you broke up the given name and did NOT put it how it was on the I94. Was this an issuse? Did your case get approved
