Entering USA on a Non-Immigrant visa with the intent to Adjust the Status is Illegal. Don't do it.. don't create a trouble for urself.

As other folks said, you can come in B2; get married and leave. Best advise is go for CR1 which will be cheaper and comes with the flexibility to work right after u land in US. But again if you guys can support each other financially and if you can stay home for 6 - 8 months then go with k1.

If AOS was that easy then no one would be going through CR1, IR1, K1 visa. We would all board the plane to US on some nonimmigrant visa like B1 / B2 and would have changed out status. Life would be much easier and there would be less mental and emotional pain of being away from your dear ones.

Hey, what do you mean with "if you guys can support each other financially and if you can stay home for 6 - 8 months then go with k1. "? I applied for a K1 and per my previous research, if we marry as soon as I land in the US, let's say in the first month, I would get my permit to work in ~30 days after filing for the green card/AOS. Can you pls let me know where I can read further on the permit to work  timing?

Current waiting times for AO/EAD card is now 120 days aftr applying... 4 months.... so, one month after arriving for planning, plus one month after marrying for gathering paperwork like certified marriage certificate (may not take that long, but dont discount this time) and then 4 months waiting for EAD/AP to be granted and reveived... 6 months from entry.....

Not sure where you are getting the information about getting the work permit 30 days after applying..

There are tons of information over here, please bear with me. I have read everything on the website, spoken to 2 immigration lawyers but obviously I am not an expert and will still have questions as we move along. I guess I assumed from the Step-by-Step Guide on How to File for Adjustment of Status for K1 and K3 Visa Holders http://www.visajourney.com/content/k1k3aos that since you can include a form to get the employment authorization while your AOS is being processed,  this would take around 30 days and that in extraordinary cases it would take 90 days, but I should review it per your comments...

Assembling the I-485 Package: Checklist

2.

I-765, Application for Employment Authorization, if you want to work while your application is processed (optional)

Employment Authorization and Advance Parole Processing

If you filed for Employment Authorization and/or Advance Parole petitions are generally processed within 90 days of filing. During that wait the beneficiary (non-US Citizen Spouse) will be sent a notice in the mail to schedule an appointment at the nearest USCIS biometrics office to have their fingerprints and photos taken. It is important follow the instructions in this notice and to schedule the biometrics appointment in a timely fashion. Below are estimated waiting times for these benefits.

We just received our EAD and we are July 2017 (Married in June) filers from K1. Currently EAD approvals are taking 100 + days. We actually seemed to get it on the shorter end of the current normal wait period. I would not assume 30 days, some peoples are well over 100 days currently.

They are currently approving May 31, 2017 for EADs according to the immigration officers on the phone and like they said above, it takes time to get married and gather the marriage certificate and put the packet correctly together. A lawyer will not make the process go any faster through the government. My husband has been waiting 5 months to work in the US and just received his approval last week.

Thanks everyone! And does anyone know if the foreign fiancé can do volunteer work or non paid work while waiting for the EAD? Just wondering what I’ll do for ~4 months!

@marinapoli I know exactly what you mean. Believe me, also from Brazil and going through the AOS journey since August. Anyways, back to your questions, you will see and probably some other people will say Yes and No. This is a long discussion in this forum of whether or not you can since you are technically working without the EAD. Bottom line is, this is a gray area and I would recommend to get a house project, books, studies, netflix etc...it is hard but I would keep myself out of anything that can eventually be a problem for your process.

I just saw your timeline and it looks like you are still on the i-129f process. Please let me know if you have any other question, will be glad to help.
