Expedition for medical reasons

Hello All,

 

So found out late last week that my wife has been diagnosed with stage 1 Cancer. She is going to under go treatment for it soon. We filled the I-130 petition back in may of this year and have not heard back since we got our NOA1. So I have a couple of questions in regards to this:

 

1) Is there an option where we can expedite the process so I can be there with my wife while she under goes treatment?

 

If yes:

2) What is the procedure for that?

3) what would be the cost that would be associated with that? Curious to know if this is something we can afford?

4)Do we need a lawyer for it, or is it something we can do by ourselves?

5)If we can expedite it, approximately how long could it take for me receive my visa from the time we file for expedition?

I am so sorry for you and your spouse! Wishing you nothing but the best!

 

You can try and lose nothing by trying, however I wouldn't get too optimistic. USCIS rarely approves expedite requests and I've heard of them deny it even in cases with terminal illness.

However, It's free to expedite and won't hurt your application if it's denied. You can do it by yourselves.

Hello,

Sorry to hear these news. Prayers on your way. You can submit an expedite request by calling the customer service number and speaking to someone. Call the number and press 1 222 and this will put you directly to a representative. Then they will take care of the request while talking with you. 

USCIS usually gets back to you about these requests in 4-5 business days maximum. However, as stated above, they are very very restrict about granting these requests. I, myself, my wife has a complicated pregnancy with high risks for her and the baby and provided even doctor's letter and it was denied two times. I work in a level I neonatal hospital and would provide her an excellent care but still, denied. 

But it never hurts to try.
