We planned a wedding while applying for the K1 ( I know it is not recommended but it can be done if you have your heart set on it and my husband really wanted it to be done). We even had my husbands family and friends attend with no issues at all.

 

I have been reading a lot of issues on here recently with family members being denied visitors visa when someone in their family is adjusting status from a visitor visa. I don't know much about that process since my husband adjusted from a K1 but its something I would be personally nervous about.

01/31/17.... K1 Visa Approved

02/03/17.... K1 Visa Received in Hand

06/05/17....Arrived in the USA (LAX)

06/24/17....Married on Cape Cod <3

 

07/10/17....Sent AOS package (I-485, I-131, I-765)

07/17/17.... AOS notice date for NOA1 (I-485, I-131, I-765)

07/21/17.... Received mailed hardcopies of NOA1s

07/29/17.... Biometrics Notice received in mail 

08/01/17.... Biometrics Appointment AOS - complete (walked in)

08/07/17.... Biometrics Appointment EAD - complete (walked in)

10/23/17.... EAD/AP card delivered to house YAY!

For a K1- what is the process? I know he would have to pay that £500 something fee, but what is the waiting time to get it after he applies?Does he need to show proof of income to sponsor me for that?

A greencard is for LIVING in the usa. if you have no plans to live there, you will loose your greencard and it is gone! 

what is the point of applying for a greencard if you are going to travel? 

also, you can not enter the stats with the intent to live! as you have a B2 visa, and you dont plan on living in the usa, then you should just plan a wedding in the USA and then you can leave after and you guys can do your missionary work? just have proof of ties of not living in the usa after and you will be fine.  seems as though you dont wan tto work anytime soon.  

also, most people actually come on a k1 and do a courthouse wedding and then do a bigger wedding later. just an FYI!

You can;t possibly plan a wedding in 60 days as per the fiance visa- well you can, but it's really hard but coordinating that is nearly impossible since I would like my parents to attend and they need US tourist visas to come..and that takes time..

Does the spouse have to show proof of $20.300 earned up until that point of filing the documents even if it;s the first few months of the year? My boyfriend just started his own business so can't make that amount in the first 3-4 months of the year. Do we need proof of the IRS docs of previous year to proof his financial stability?

Thank you all so much.

I had no idea this is so crazy. I honestly didn't know about all of this.

So I guess best thing is to get legally married then return home and apply for the CR-1 and then visit with my B2 visa 6 months at a time, until the CR-1 comes through with the green card. And one of the times when I visit with my B2- we can do the wedding and reception and everything and have the family come over as well.

So just to make sure, since he is building his own business now, he will have to show proof of $20.300 for the previous 12 months and the previous 2016 and 2015 tax return?

 

How long does the Cr1 take to process?

 

I have a 5 years B2 visa so I assume I can visit 6 months at a time no?

ya, I am just learning about all of this.

 

Best is get the CR1 going and get married legally in the Us then head back and visit for 6 months at a time til that comes through.

I will just have to live off my savings until we get the CR1.

Current income is what counts.

 

CR1 takes a year or so presumably he will have evidence of income by then.

 

Usually entries are for max 6 months, but up to the PoE, what do you do that gives you so much vacation?

I actually can live on my savings for around a year without having to worry about anything. So CR1 is best..if I can visit him 6 months at a time, then we'll make it until that comes through.

I honestly had no idea of this whole thing. but everything will work out. I'm sure of it.

Someone please confirm this, but as far as I'm concerned, you are not allowed to visit when you're waiting for a spousal visa. I have a visitors visa myself, and visiting was a concern we had, that's why we went for the K-1 instead of the CR-1, because you're able to visit while the process is going on. But by no means can you stay 6 months at a time, that's practically living in the US, and visitors visas are not for that.

when u are undergoing CR1 or IR1 visa, you can visit US on Visitor Visa. Just make sure you carry enough proof to prove your ties back home and be prepared to be sent to the secondary room by CBP for further questioning.
