Timeline

Hello! After receiving a request for evidence after we sent our I-175 package last year, we are assembling our new package and need to know if we need to resend the I-175 form. We probably don't but I just really need to know to be sure.

Do make sure you include a copy of the RFE.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Thank you! We will send the rfe letter they sent us and well as the following:

 

A letter from the landlord of the apartment we lived in last year

* Copy of the first page of the lease of the apartment we lived in last year

* Proof of shared homeowner’s insurance for the above mentioned address

* A letter from our current landlord confirming that we both in fact live at our current address

* Copy of the upcoming lease for our current apartment for the period of March 2018 to March 2019 with both our names on it. 

* Bank statements from our joint account from every month since I’ve added my husband to my account

* A letter from our bank, explaining that my husband was added to the credit card account as an authorized user, since his name isn’t on the credit card statements.

* Credit card statements dating back from when we started using the credit card, showing all expenses, representing our joint ownership of assets and joint responsibility for liabilities.

* A summary of my benefits from my employer for 2017 showing my husband as my beneficiary for life insurance and my dependent for health insurance.

* A print out from my employments benefits page showing my husband as my beneficiary for life insurance.

* A summary of my benefit elections for 2018 showing my husband as my beneficiary for life insurance and my dependent for health insurance. Please note I am still under my father’s medical insurance until 2018, so I wasn’t able to sign up for medical benefits through my job before now.

* Copy of a dental explanation of benefits showing a joint policy.

* Plane ticket receipts from a trip we took

We sent the I-175 package in mid November of last year, so a little under a year. It was the Vermont Service Center. They were super behind for a while and it seems they sped up their process by sending out RFE's to buy time instead of actually taking the time to examine people's packages....

Well they spend up those four months super quickly by sending people RFE's lol. My husband's green card expires in Feb so we really need to get all this sorted before then...

Hi I just started preparing my i-175 package and trying to understand the process.  Can I ask what evidence you included in your original submission?  I'm worried I don't have very strong evidence in regard to mortgage and shared bills because all of them are in my husbands name.

I know, it's rough :/. We submitted a lease that had me as the tenant and my husband as the authorized occupant. They seemed to have missed his name though...

I submitted a bank statement from our joint bank account that has both our names on it. We also submitted plane ticket boarding passes which they didn't like because boarding passes don't have years on them. We submitted our ID's with a same address, some pictures, some post cards that were sent to both of us. Also the 2015 tax return which shows that we filed jointly as a married couple.

I actually have another question. We lived with my parents in 2015 and therefore do not have a lease from this time. I made note of that in the cover letter and said that the address that we lived in at the time is where our bank account is tied to (it's listed as our billing address for our bank statements) and it's where our 2015 tax return says we lived. I'm hoping this is enough. Let me know what you think!
