K1 interview & J1 2 year home residency requirement + limited dates to schedule K1 interview

Hello,

 

We have officially received our NOA2, and recently the consulate from Rio emailed us and said we can now schedule our interview and medical exam. However, on the website there are only TWO dates offered: November 21st and November 28th. My fiancé's two year home residency requirement will be fulfilled on November 30th. Our original plan was to wait until December to avoid any sort of conflict, but there is only two options for the interview! Our question is, do we schedule the interview anyway? Can the consulate wait to issue the visa until the 30th? We don't want to be denied because we went to an interview two days before the home residency requirement (HRR) was fulfilled. We've been very straightforward about this in all of our paperwork by explicitly stating the dates the HRR would be fulfilled and that we would go to the interview after Nov. 30th. However, this isn't an option at this point.

 

I also wanted to let other Brazilian applicants know that there will be VERY limited options for dates and times to schedule your interview.

@LandurerasonWell this is a tricky one....first thing is, the web site changes regularly and you always be able to move your interview (if I`m not wrong if you are at lease two days before the interview).......One thing I`m not familiar and it is not clear, so the HRR on Nov 30 will require her to go back to Brazil correct?

 

Anyways, just as a feedback I had to reschedule my interview once and you will have to be visiting the site constantly and see empty spots on the agenda. 

8/14/17 --- AOS sent I-485, I-765, I-131

8/16/17 --- AOS Packet received Chicago USCIS Day 0

8/21/17  --- Received email & text notification 

8/23/17  --- Received hard copy of NOA  

9/01/17  --- Biometrics letter notice for I-485 & I-765 & I-131  

9/11/17  --- Biometrics Appointment Done

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

2/26/18  --- USCIS Mobile Status changed to "Card was mailed to me"

2/28/18 --- Permanent Resident/Green Card received :jest:

" Have you tried the search tool? K1 isnt an easy process and a LOT of reading is required to avoid problems (RFEs) etc, if you dont like reading, be prepared to spend WAY more time and couple more $$$ with an lawyer "

Good to know. We actually contacted the consulate and we were told we can go to the interview on Nov. 28th and if all goes well, they will issue our visa after the 30th. :)

I've been looking for this information for so long. Thank you and good luck in the interview! So you had no issues at the NVC stage because the two-year requirement hadn't been fulfilled yet?

Happy to help! No problems! Our visa was actually issued today!! The officer asked my fiancé about his J1, and he told the officer it would be fulfilled the end of November. The officer said it was no problem. :)

Hi again! I'm filling out the DS-260 and I'm stuck in the following question: Are you a former exchange visitor (J) who has not yet fulfilled the two-year foreign residence requirement?  The requirement will be fulfilled on Oct, 30th and that's when I plan to have the interview at the consulate, but I'm afraid that if I say YES to that question, the case is going to be straight up rejected. What did you guys answer? Thank you so much again!!!
