Submitting I-485 AOS Package without I-693

How have been the results of those who have Adjusted Status as an approved K-1 applicant without sending in a I-693 form in their AOS package?

 

There is a sticky here in this forum about this....but it is years old and I'd like to confirm how this works.  It is my understanding the I-693 can be omitted completely from the I-485 AOS application???  Only if the DS-3025 is marked in the "Summary" section as "US Vaccination Requirements COMPLETE"???

 

I'm trying to avoid an unnecessary RFE.  On my package's cover letter, I'm including the following note:

 

NOTE: Per the I-693 Instructions, Page 7, “Frequently Asked Questions”: If you were admitted as K-1 Fiancé with no class A medical condition, a new medical exam (Form I-693) is not required, but you still must show proof you complied with vaccination requirements (DS-3025).

 

 

Thoughts on my cover page note?  My package will include a copy of the completed DS-3025 marked "COMPLETE".  My package will not include a new I-693.

Says we (K1 applicants) are STILL REQUIRED to submit portions of the I-693 and have a civil surgeon certify the form, even if we had an overseas medical done already.  So I am a bit confused.

 

How has the experiences been from others regarding this?  Any RFE's issued due to not submitting I-693 when you only submitted DS-3025?

I think the cover page note is fine, I put something similar in mine. I understood the same, that the I-693 is not required within a year of your original overseas medical, providing the vaccination sheet is correctly filled in. However, there is always a chance that your medical paperwork is lost and a new I-693 can be requested. I believe this has happened during the AOS process, whilst waiting for the interview, and also at the interview itself, when the IO can ask for a new medical.

 

I have my interview in two weeks and will take a copy of the I-693 instructions, in case questions arise. Our AOS was submitted in August and up to now, we haven't received an RFE about it. Like you, I included only a copy of the DS-3025 marked as complete.

 

I'll update after the interview and let you know if there was any issue with the medical.

Completed DS-3025 marked "COMPLETE" does not mean the doctor completed the form correctly.  It seems to be the officer's discretion to determine if it was done properly.

 

Their policy manual says:

"The officer should be aware that civil surgeons may improperly mark the boxes because they may misunderstand the meaning of these boxes. Therefore, the officer should determine, from the vaccination assessment completed by the civil surgeon, whether the applicant received all vaccines, which blanket waivers should be granted, and whether the applicant requires any other waivers. The officer should exercise discretion in reviewing the vaccination chart and when evaluating the results boxes at the bottom of the vaccination assessment chart. If the civil surgeon did not check any result boxes, the officer should only return the form for corrective action if he or she is unable to ascertain whether the applicant is admissible. "

DS-3025 marked complete is all you need to send regards to the medical/vaccinations if you file for AOS within 1 year of the overseas medical.

 

I bet there are some who received an RFE even if they shouldn't - there are even British born people who received RFEs for not sending a translation of their birth certificate (!!). 

 

So, no matter what you do, how well you do it or how much you stick to the rules and the checklists - you can never be 100% sure you won't receive an RFE. You have to realize you're dealing with PEOPLE, some of them will be less intelligent and knowledgable than others.. Some will send you RFEs you absolutely shouldn't receive, others won't.

 

All you can do is send your DS-3025 marked complete and hope that your case ends up with a person who knows what s/he is doing.

 

I would never recommend anyone to spend money on unnecessary things related to immigration (which is already expensive as it is). You probably won't receive an RFE for not having a filled out i-693, in that case it would be very wasted money. If you for some odd reason would receive an RFE for this (which I doubt) it's an easy fix and an RFE is definitely not a big deal whatsoever.

When you guys submitted the DS-3025 with the I-485 package, did you also include copies of the vaccination chart/booklet?

 

Stapled to my wife's DS-3025 is  the doctor records from since she was a child, of all her vaccines.  Then summarized on the DS-3025.  Should I copy the doctor records too and include it?

I sent a copy of the whole medical but most people only send in the DS-3025, no extra vaccination papers or anything. But since you have it you can might as well copy it and send it in too, it probably won't do any good but it won't hurt either.

I thought any supplemental vaccination updates not on the original ds-3025 needs to be transcribed by civil surgeon.   basically ,you show your updated vaccination record to the civil surgeon and they transcribe onto I-693. then the doctor seals in a envelope it for you to send it along with it I485? Simple sending your doctor's note along with the original ds-3025 may still trigger a RFE?
