Discriminated at job interview

My husband just applied to usps and passed the test he is also conditional resident currently in ROC. He got an interview email today however just found out today by looking online that he can't go for it because he's a conditional resident. So he will just say no to the interview opportunity. My question is will he get in trouble for attempting to apply as a conditional resident. I did look on the basic application which does ask are you us citizen or US resident whose not a refugee or conditional green card holder. He checked yes,i guess he didn't read the question in full. At the end of the application it says:

'I certify that all of the statements made in this application are true and correct to the best of my knowledge and are in good faith.'A false or dishonest answer to any question may be grounds for not employing you or dismissing you afteryou begin work and may be punishable by fine or imprisonment (US Code Title 18 Sec. 2001). All informationyou give will be considered in reviewing your application and is subject to investigation.

Even though he's saying no to the interview will he get in trouble for answering the eligibility question wrongly?

I don't think he'll "get in trouble" - as we know from how shocked the rest of us were by this "no conditional resident" rule, it's hardly common knowledge, and I (and most people) would believe that this was an honest mistake. (ie: in good faith - he didn't intend to deceive, he made a mistake and he's correcting it by refusing the interview based on the fact that he's realized he's not actually eligible for the job.

He emailed them today refusing the interview and asking them to please withdraw his application.

Two things: one I work for the USPS and do some hiring... Different district than the OP. My comments in no way are meant to represent or speak for the Postal Service. But as a person, I would  like to apologize for the way the OP was treated. It sounds like they could have been treated with WAY more dignity and class. Second for corvusheart, the USPS doesn't turn applications over to the USCIS unless there's an actual investigation... Miss applying wouldn't trigger an investigation. We get so many applications that reviewing all those that have been withdrawn would slow the process and provide no real benefit to the postal service. If your husband had been hired, there's an actual background check that the Postal Inspectors run with the FBI. And if he would have marked that he was a citizen on that form, then there might have been follow up. But at the application stage of the game, I wouldn't be concerned at all.

Thanks for the reply. If he reapplies after he gets his 10 year card will there be confusion when they look at his test score and see he took and passed postal exam before he was eligible?

Thanks for the great information. I work for usps as well but only as a clerk and it's been forever since the time I was hired. I hope OP reads your reply as well.

Yesterday, someone from Dept of Justice called me.  Even though I-9 says employers should not to ask for specific document, there are exceptions to certain type of jobs such as goverment jobs. So USPS can request 10 year GCs. I asked her if those explanations of exeptions can be added to I-9 but she said  there are too many exceptions and if those are added to the form, form will be too long . Before I received a call from Dept of Justice, I have already withdrawn from all of positions at USPS I applied so that I and USPS won't waste times. I would have been rejected at the time of background check anyways.

Your postal exam score will be good for 6 years. So you could always reapply after you get your 10 year GC that's what my hubby is going to do. They are going to be hiring for a while.
