Timeline

I am counting on reply from Dept of Justice regarding  USPS not accepting conditional GC holders but

they accept applications from GC holders.

And I-9's right for us to work with any type of document.

For employment, LPR is LPR. 

Read your own link. You're wrong. It's spelled out clearly that CONDITIONAL RESIDENTS ARENT ELIGBLE FOR EMPLOYMENT.

This is a clear distinction: "Individuals granted only asylum status, refugee status, or conditional permanent resident status are not eligible for Postal Service employment." It is the reason why they didn't hire me.

 

 

the employer can choose. Just as the government can choose to hire Citizens only.

USPS jobs are federal jobs so are you are citizen?

When I applied for IRS job I had to bring a copy of my naturalization certificate or US passport , SSN, etc. That's the normal routine.

Sometimes being nice to people will get them to go above and beyond their job duties for you...just a little advice.

 

By the way, Amazon is hiring..UPS is hiring...try a different place.

I don't know about that, they are always looking for people to fill postal positions where I live.  Something about having to walk around for hours in -20° F weather every day, doesn't appeal to a lot of people.  I exaggerate, it is closer to 0° F most days in winter. ;)   Then there is the season where you walk in mud all the time and then are chased by yellow jackets.

I'm interested to see what exactly happens here. I do contract work for USPS through my employer.

 

Keep in mind USPS is a federal agency, so they are allowed to set their own rules in ways that private employers are not allowed to do. But it's still odd (IMO) for them to accept LPRs but require certain documentation or distinguish between conditional LPRs and non-conditional LPRs.

Considering I personally know a bunch of immigrants who currently work and have worked for USPS for years.. I have a feeling that this case boils down to ignorance with HR, not obscure wording that runs contrary to federal law. Hope the OP gets answers.

I hope you get the answers and share it with us all.  I think the thing here that really gets to me is that if USPS hire whether its conditional, permanent or citizens then there needs to be clarity on the documents they require. The person you spoke to had no clarity, they needed to refer to their manager and I can imagine how uncomfortable you must have felt trying to get your point of view across and being met by deaf ears. I felt the same when I applied for a state id. I wanted the ground to swallow me up and my husband was so, very, very angry that I had to go through the humiliation in front of other customers at the DVLA centre.

I've seen this myself in the 3 companies I've worked so far since I started working in the US where they don't take the extension letter as a proof of legal residency and people turn down jobs for that. I know exactly what the letter says but the USCIS somehow contradicts itself.

 

Plus in their website they are very clear about the elegibility...remember the USPS is a FEDERAL AGENCY

This requirement is addressed at the application screening stage by reviewing the applicant’s answer to Item E1, PS Form 2591, Application for Employment. Citizenship documents are not reviewed at this stage.

On PS Form 2591, if the applicant responds that he or she

  1. Is not a U.S. citizen, a lawful permanent resident alien, or a citizen of American Samoa or other territory owing permanent allegiance to the United States, the applicant is not eligible for employment.
  2. Is a U.S. citizen, a lawful permanent resident alien, or a citizen of American Samoa or other territory owing permanent allegiance to the United States, then the applicant continues in the hiring process.

 

My wife just started a new job this week with a rather large company. She provided her green card and the extension letter. They were satisfied. And that manual you referred to says an extension letter is acceptable:

 

The combination of an expired Permanent Resident Card and a Form I-797, Notice of Action, that indicates that the card is valid for an additional year, is an acceptable List C evidence of employment authorization for one year as indicated on Form I-797. At the end of the one-year period, you must reverify. 

 

That is on page 20 of the manual BTW, just in case you want to confirm.

That only refers to how it is organized. It's still legally a federal agency and employees are federal employees.

Job post said I had to be a lawful permanent resident. According to the link above, I am one. 

Anyway, they are doing screening and checking my status with DL and SSN. I will find out soon. 

Your AOS hasn't even processed yet so you are not a Permanent Resident yet but a conditional one. 

 

You are not entitled to a job, and being that you do not have a preference you probably won't get it.

Well good luck getting it anytime soon because it will take weeks if not months to sort out.

Thats where you are mistaken according to USCIS a Conditional permanent resident is a permanent resident and in order to remain permanent resident he/she has to remove conditions.
