Discriminated at job interview

I just have to spill this out.

I went to open hire job interview at USPS today. The person in charge at the interview

said I HAVE to provide green card. So I pointed out the form I-9 and telling her to read the top part about

anti-discrimination. She kept saying "I know. I know", but she didn't know what I was talking about. So I told her

again to read that part. It seems to be something she didn't know that she can't demand green card from me to

prove the lawful status. Then she goes "I still need your proof of A number". I told her it is written on

my visa on my passport. ( pending I-751) Then she goes that  does not prove. I told her to check my SSN. It should prove

my lawful status with A#. She goes again " it is up to them(her manager) to decide".

It is so biased, as this woman was asking everyone their nationality which most of them were U.S. Citizens.

So if applicants answered as "yes to US Citizens" , why she didn't ask for proof????

Oh man, I was furious.  This woman knows nothing!!  I wish I could make a huge complaint to

her manager but don't know who to call. I already withdrawn from this postion. It is not worth precious time.

I was so discriminated. I went for another position's interview at same building in USPS, the lady who was making copies

of our D/L and SSN told me that I don't have to provide copy of my visa. So this lady know the process.

 

Unfortunately, many employers don't knwo our process with USCIS. I wish there was a document to present to

employers so that what they are doing is so wrong.

the document is the Green Card - even if it is expired , you can have USCIS put a sticker on the back of it with an extension if your I-751 is in process. 

 

Unless you show the Green Card , that has your photo on it, they cannot just use the SSN because you could be stealing someone's identity.

 

For US citizens they request passport or birth certificate as proof.

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

  • 8/28/2007 DS3032 choice of agent accepted
  • 9/3/2007 IV fee bill generated

You can use an i55i stamp if you have one. (I think, looking at the list that is acceptable). That would have shown your alien registration number. You're correct you don't have to show your GC. I couldn't show one as I don't have one and most people who file for ROC and are given a stamp have their GC taken off them.  so they would need to accept the i55i stamp if they didn't  want to come across as discriminatory.  I would most certainly make a complaint if you showed the stamp and she still refused it.  I would complain to the HR department of USPS, which I am sure they have and if not Im sure they can point you into the right direction. It's sounds to me like a lack of training.

I would skip USPS HR dept and directly file a charge with the Justice Department's Immigrant and Employee Rights Section. You can even do it online.

It is my first time applying for a 10 year green card. USCIS agent at local office told me that only those who already

have 10 year GC and renewing it can get stickers on existing GC. In my case, I only recieved an extension letter as

I am still with conditions. I have valid D/L,  and unrestricted SSN and valid I-551.

My extension letter has already expired so before it expired, I went to USCIS local office and officer gave me

a conditional permanent resident stamp valid for a year while I-751 is still pending.

Yeah, this woman is lack of knowledge. She thinks only way ailiens can work is thouse who have "Green Card".

And if anything, she would say this is a government job. But any jobs should take proper channels.

 

I think I found a person whom I can make a complain to in USPS. But I will take broppy's advice and email dept of

justice first.

Has anyone done this before? What is the typical timeline to get a response/result? If they are fast like within days or 1-2 weeks, it is good but if they are going to take another few months, what good it is if the CPR is currently in need of a job or the one that ignorantly denies the paperwork is a dream job?

There's a sticky thread in the Working & Traveling forum. It's from a couple of years ago (when IER was known as OSC), but their response at the time was pretty quick.

I just filed a case with IER. I will update if they contact me how they will handle the case.

I sure hope they will contact USPS asap and the staff in question will be aware that

I filed the case.

Many employers seem to be very ignorant. They think only way for Aliens to be able to work is those

who has Green cards. We have to renew them and there is alreay waiting period.

OP,  You seem to think you are entitled to the job and other than this issue you would have it.  I seriously doubt it as USPS jobs - in fact all government type jobs - are in demand.  An immigrant has no preference over  vets and the disabled.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

USPS doesn't hire conditional residents. It is in their policy manual last I checked. They hire permanent residents.

Lawfull permanent residents are eligible to be hired - no distinction made on 2- or 10-year green card, or i551:
