Marriage isn't valid? (split)

Yes it happend to my wife also she took everything to the class that was listed after she got there they let her go through the whole class and interview when it was over she told my wife she'd be put on hold because our marriage was not valid because they wanted a special marriage certificate that we didn't have me were married on 8/17/2017 her interview at CFO was on 9/29/2017 she took our marriage certificate but the even gave her a receipt and told her she would have to come back how could our marriage not be valid when it was done by a judge in the trial court room with many of witnesses and we even have a marriage certificate I've never been married before neither has my wife we are both of legal age  she's 28 I'm 40. How can it be that our marriage isn't valid?????? Someone please tell me what this means recently my wife went to NSO and was able to get a Cenomar how could this be??????????

You must provide a PSA (was NSO) marriage certificate.    CENOMAR is a different document, required also, but different.

I got my marriage certificate in psa/nso after 6months I get married..

Cenomar or a Cemar? If she got a Cenomar then that means your marriage is not registered with the NSO at all and it needs to be registered.

Thanks for all your comments ok so let me get this right we got married in the Philippines on 8/17/17 so another couple also an American citizen and his fiance in the same city at the RTC court and they already have their marriage certificate in PSA paper how is this they have reported having it around Sept 20/17 why does it take 6 months for mine and someone at NSO has told my wife it could take a year is this true????? And are there anything we can do to get this also her passport has expired does DFA need that same PSA marriage certificate or can she just not change her name on the passport ?

It's hard to explain "how things are done" in the PI.  Having said that if time is of the essence to have a valid passport you may want to just go ahead and use her "maiden" name and deal with the process of changing the name at a later date. When she travels she should carry her marriage certificate in the event it is required by any government agency in those travels.

I'm thinking she (your asawa) didn't understand. I doubt that they said your marriage is invalid. The problem is she had the marriage certificate from the local registar where you got married. That is also sent to Manila PSA by the local registar to be registered. It takes several weeks up to 6 months for the information to show up in the PSA database depending on how fast the local registar gets the info to Manila. Once the PSA has record of your marriage you can order an official PSA marriage certificate. That is what she needs.

Ok then very well so why would it take 6 months to get the certificate why can't they just accept the Marriage certificate we got from the local registar ? Is there anyway we can fix this and CFO gave her a receipt for the class so all she needs to do is go back there with the PSA marriage certificate and then they'll give her the certificate?????? If it takes 6 months will they make her retake the class?

Welcome to the Philippines :mellow: It's not official until it's in the PSA.

 

Not sure about CFO as we have not got to that phase yet.

 

As for the process of getting the PSA certificate I would take the local certificate to the local registar and inquire with them. Have your asawa let them know how urgent she needs it for travel. That's about all she can do.

Here is how it works: (You might have done some of the steps that's ok... just walk through each step to completion)

 

  1. Once you attain the divorce/annulment (works for either or) you will need the decision of the divorce (works also for an annulment), entry of judgment, then the decree of divorce (annulment).
  2. Then you’ll need to secure copy of the marriage contract with the divorce (annulment) annotated on it. A total of four documents.
  3. You’ll need to wait 20 days from receipt of the Solicitor General of copy of the decision before you can secure the Entry of Judgment.
  4. After securing the Entry of Judgment, you will have to register the same to the Local Civil Registrar where the marriage took place or Filipino’s hometown. The said office will transmit the same to the NSO.
  5. You will show the Court what date the LCR transmitted the documents to the NSO. With the proof of receipt of the NSO, the Court will then issue the Decree of Divorce (Annulment). After 15 days from receipt of the NSO of your documents, you can now request a copy of the marriage contract with the annotated divorce (annulment) proceedings. You need to request at least 4 certified copies for future use. 

 

It took from beginning to document in hand, about 30-45 days for my wife.

With PSA the form for a CENOMAR is submitted , if married they will issue the CEMAR .   But this is not the marriage certificate, that is a different document totally.

This is good advice. My wife did everything for her emigration to Japan in maiden name, and didn't do a name change on anything until time for the next passport renewal after she'd already been here 3 years and even been through a zairyu card renewal in the maiden name. Thankfully name change is pretty easy on the Japan side.

So the marriage certificate we got from the Civil registar is not of any use????? Someone told me that it can take up to one year to get your marriage certificate and also to the person who commented about marriage and divorce me nor my wife had ever been married to any before there has to be a way to get a marriage certificate in the Philippines in less than a year.

Sometimes its faster (usually less than a month) sometimes its slower. Did you read or try what I said earlier?

She needs to start her pushing there. If you can confirm that they have sent it and that the PSA has received it, then you focus your efforts on the PSA. If your asawa is not pushy, you will need to teach her to be. Pinay are often timid and shy and don't want to make waves. They accept the first answer given. In these situations she needs to learn to ask for a supervisor. Keep pushing till you get to a person with authority. She can't just accept the answer no, or just wait.
