Thank you, I tried calling numerous times on Friday but kept getting hung up on, cut off and kept on hold.  So I should be asking for a tier 2 or ISO right away.

I highly recommend to fire the lawyer and do it yourself. This is faaaar from the only case we've seen on here where lawyers take people's money and either don't care to keep in contact (people are even missing RFEs because of this) or just mess things up with the application. They don't care, it's not their future on the line.

I have spoken to my lawyer after noticing my i-130 was approved for AOS rather than consular processing, my lawyer told me that it was the USCIS’ fault, I’m not interested who is at fault as I just want to get this rectified as soon as possible.

I understand that I need to submit a i-824 form, what I need to understand is how long it will take to get my approved i-130 moved from USCIS to NVC.

I can’t see how I can track it and what the process is.

Does anyone have any recent experiences with this?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Reading the CSC's info it looks like its taking just over a month, am I reading it corectly?

 

Also I could not find the I-824 on the TSC page (where my original I-130 was filed)

Really you don't need the I-824 at this time.  Especially if the I-485 wasnt filed.  This is a USCIS error and they should fix it without cost or filing any extra paperwork.  I have seen this happen more times than I have fingers to count on.
