I've used lawyers for both my immigration petitions (I-130/I-485 and I-751) and I ALWAYS read through EVERYTHING before signing and submitting. I feel like I'm paying them to compile the documentation and make sure it's complete but at the end of the day it's your process and it impacts your life way more than it does the lawyer's. It's in your best interest to understand what's going on and when you don't, this is what happens.

You hope they would make all the right decisions, but personal responsibility is also needed here. The lawyer isn't the one planning to immigrate. To steal somebody else's words, you need to study the process and the forms and become an A student to minimize risks and get through the process as quickly as possible. A lawyer does not alleviate this requirement.

If you only knew how many stories you can find here on VJ about lawyers messing things up for people...

 

So no, doesn't matter how much you pay the lawyer or how much of a specialist the lawyer is, you should always check everything yourself and not sign anything you haven't read up on first. The lawyer is just there to take your money for something you could very easily do yourself, it is in your interest to get things right.

 

What's done is done though. And lesson learned i hope. And maybe no lawyer at all next time.

It only works if you stay in Mexico though thus only works for Mexicans. If you can't prove with records that you left on time, you won't be getting the benefit of the doubt. Very risky thing to rely on the no-border checking to Mexico. I would not advise to do so especially because it can be anticipated to become more strict. Also you might end up with a misrep later which is a lifetime ban instead of a simple overstay ban.    

Thank you, that was precisely the point I was trying to make - that there could be no actual benefit to doing it this way, and potentially you could make it a lot worse for yourself.

I don't believe an I-485 was filed (or I-131 or I-765). Cost for that is $1225. I think I'd know if $1225 was missing from the bank account. Also there would be NOAs (I-797s) for them. 

 

OP, why do you want the lawyer to handle it and not your wife? The lawyer has already messed up and charged for a service he did not fully provide. It almost sounds like you're hiding something from your wife. That's not a good start.

I want the lawyer to rectify their mistake (which I paid for) and I want to go back to my wife with a solution not a problem... she has enough to worry about.

You have a solution. You're not creating a problem.  But as stated your choice but a small suggestion would be to stay on top of this lawyer and find out exactly what was sent and billed for.  Imho you're entitled to that since you're paying for their services.

I agree the solution is the normal CR1 process you are going through.

 

And you need to pay more attention to what is going on. Not that complicated, most people DIY.

Yes, I understand Mr. ****, but the people that answered the call when you called are USCIS agents and not officers. To speak to an officer, they have to escalate the call and you usually have to wait a few hours to be able to talk to one.

We will contact you with an update as soon as possible.

It is correct. When you call you talk to Tier 1, you have to ask to be escalated to Tier 2 to talk to an officer.

Tier 1 is mostly useless.

Yes a tier 2 or iso  (immigration services officer) can see deeper into the case and can actually help you.  Generally takes a few hours on hold.  Lawyers charge you for this time....
