Patrick is coming for a visit soon. He's only going to stay in the US for 2 weeks or so, then he will go back. What causes the immigration officials to turn you away? We NEED this visit and I am teaching right now so I can't go. What can we do to ensure that he will not be turned away at the gates?

One good idea might be to send Patrick a copy of the NOA-2, with an explanation that the case will be forwarded to the Embassy/Consulate--and that he will HAVE to leave US for the interview.

Maybe surprising, but the necessity to leave US to do the consular interview (including for employment-based GC's) is enough in USCIS eyes to negate immigrant intent. :wacko:

(not a guarantee that USCIS officious will allow in though--unfortunately, it IS up to the officious' discretion)

It is CRUCIAL that he show "why" he will be leaving after his visit.

They just want to make sure that he isn't going to stay illegally. Whatever he can bring to prove he will be leaving after his 2 week visit will be what they are looking for. Keep in mind though-it is ultimately up to the officer-so anything could happen.

Make sure he's not going through Atlanta!!!!!!! Have almost been sent back by Officer Butler there last month.

Your NoA 2 should be enough evidence and a VERY good reason that he wants to leave the USA again to attend his interview and proof that he DOES NOT want to stay in the US illegally.

Be careful with other evidence,they've tried to use that against me last month!!!!!!

Other approaches for this trip:

  • Through Dublin or Shannon (immigration cleared there), change at US landing-point (there are no direct Dublin/Shannon to Atlanta flights, and you need to factor in the delay for CUSTOMS clearance with this approach)
  • Through Montreal or Toronto; both have PFI's where you clear US C&I--unfortunately, you also need to clear Canadian C&I both ways, even though only in transit

Both approaches only real advantage is that of avoiding "Officious Butler".

Guess it depends on what kind of mood they are in. The Noa2 is definetly good proof that you will want to return home just don't forget to bring anything and everyting else you can. lots of luck.

Unless your destination is close to Buffalo AND your starting point between Chatham and Ottawa (highly improbably for a VWP visitor), that's really an out-of-the-way approach.

Make sure he's not going through Atlanta!!!!!!! Have almost been sent back by Officer Butler there last month.

I don't think he knows where to go to get a fax. Where are some places in Scotland? He's not as resourceful as I am, he'll just say he doesn't know and never think to call a place lol.

I'll check and see if I can fax the NOA2 to his workplace. He has his contract for his work which shows his proof of employment. He doesn't really have any bills. Would he be able to bring his car title or something to show that he has the auto and he has to pay yearly taxes and such? I'm not sure how strongly that ties him, but it is something isn't it? Would existing bank account help too? I mean it shows that he still has his finances in Scotland. Any other suggestions would be helpful because seriously he has no bills except for that car of his (not a car payment, just the tax).
